An Ordinance of the City of South Bend, Indiana appropriating the sum of One Million Five Hundred Thousand Dollars ($1,500,000) for the acquisition of land, easements and rights -of -way and the con- struction thereon of major arterial streets to extend the inner belt street system; for the con- struction and equipping or the remodeling and equipping of a building for use as a fire station and the acquisition, improvement and landscaping of any land necessary as a site therefor; construc- tion of sewers; construction, reconstruction and improving of streets; and the engineering, archi- tectural, appraisal, abstracting, title insurance and legal fees and expenses incidental thereto and the expenses and legal fees on account of the issuance of bonds therefor and declaring that an extraordinary emergency exists for the expenditure of said funds. WHEREAS, the Board of Public Works and Safety of the City of South Bend, Indiana has found that it would be for the best interests of said City and its citizens to .provide funds for the acquisition of land, easements and rights -of- way and the construction thereon of major arterial streets to extend the inner belt street system; for the construction and equipping or the remodeling and equipping of a building for use as a fire station and the acquisition, improvement and landscaping of any land necessary as a site therefor; construction of sewers; construction, reconstruction and improving of streets; and the engineering, archi- tectural, appraisal, abstracting, title insurance and legal fees and expenses incidental thereto and the expenses and legal fees on account of the issuance of bonds therefor in the approximate amount of One Million Five Hundred Thousand Dollars ($1,500,000); and WHEREAS, the Board of Public Works and Safety has filed a request for an appropriation in the amount of One Million Five Hundred Thousand Dollars ($1,500,000) for said .purposes, which request has been approved by the City I Controller with the recommendation that the funds necessary to cover such appro- priation be obtained by the issuance and sale of general obligation bonds of the City; and , WHEREAS, a petition has been filed under the ,provisions of Chapter 119 of the Acts of 1937, as amended, by more than fifty (50) owners of taxable real -1- estate in the City of South Bend, Indiana requesting the Common Council to issue bonds in an amount not exceeding One Million Five Hundred Thousand Dollars ($1,500,000) for the purpose of procuring funds to be applied on the cost of the projects hereinbefore described; and WHEREAS, the Council now finds that an extraordinary emergency exists for the expenditure of more money than was set out in detail in the published budget and that the said acquisition, construction, equipping and improvements are necessary in order to .protect the well -being and the ,property of its citizens and will be of general benefit to the entire City and its citizens; and WHEREAS, the Council now finds that the City has no funds available or provided for in the existing budgets and tax levies which may be applied on said projects, making it necessary to authorize the issuance of bonds of the City in order to ,procure such funds, and that an extraordinary emergency exists for the making of the additional appropriation hereinafter set out; NOW, THEREFORE: BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND: Section 1. That the sum of One Million Five Hundred Thousand Dollars ($1,500,000) be, and the same is, hereby appropriated out of the .proceeds of the bonds designated as "Municipal Bonds of 1967" heretofore authorized to be issued to provide funds for the cost of acquisition of land, easements and rights -of -way and the construction thereon of major arterial streets to extend the inner belt street system; for the construction and equipping or the remodeling and equipping of a building for use as a fire station and the acquisition, improvement and landscaping of any land necessary as a site therefor; construction of sewers; construction, reconstruction and improving of streets; and the engineering, archi- tectural, appraisal, abstracting, title insurance and legal fees and expenses incidental thereto and the expenses and legal fees incidental to the issuance of said bonds. TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: The Board of Public Works and Safety of the City of South Bend, Indiana has requested that funds in an amount not to exceed One Million Five Hundred Thousand Dollars ($1,500,000) be provided for the cost of acquisition of land, easements and rights -of -way and the construction thereon of major arterial streets to extend the inner belt street system; for the construction and equipping or the remodeling and equipping of a building for use as a fire station and the acqui- sition, improvement and landscaping of any land necessary as a site therefor; construction of sewers; construction, reconstruction and improving of streets; and the engineering, architectural, appraisal, abstracting, title insurance and legal fees and expenses incidental thereto and the expenses and legal fees incidental to the issuance of bonds therefor. I recommend that said appropriation be made, and I am submitting here- with for consideration of the Council a form of ordinance authorizing such appropriation. Dated this day of November, 1966.
