AN ORDINANCE AMENDING SECTION 4o -8 -c
OF THE MUNICIPAL CODE OF THE CITY OF
SOUTH BEND, INDIANA, 1962, AS AMENDED
ALSO KNOWN AS ORDINANCE NO. 3702, THE
ZONING ORDINANCE OF THE CITY OF SOUTH
BEND, INDIANA, AS AMENDED

BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
Section 1:
That Section 40 -8 -c of the Municipal Code of the City
of South Bend, Indiana, 1962, as amended, be amended by the
addition thereto of the following:
"Provided however, if for any reason the petition
is withdrawn after a public hearing held by the Area Plan
Commission, a second or subsequent petition covering the
same property or portion thereof, requesting relief within
the same use district, shall not be considered by the Common
Council until one year has elapsed following its withdrawal
by the petitioner."
Section 2:
This Ordinance shall be in full force and effect from
and after its enactment, approval by the Mayor and legal
publication.
