AN ORDINANCE AUTHORIZING THE TRANSFER OF
$31,394.36 FROM THE STREET AND TRAFFIC
FUND AND $23,042.60 FROM THE CITY PLAN
FUND TO THE GENERAL FUND AND APPROPRIATING
FROM THE GENERAL FUND THE SUM OF
$48,000.00 TO ACCOUNT B -53 "REFUND, AWARDS
AND INDEMNITIESC° IN THE OFFICE OF CONTROLLER.
WHEREAS, the purposes for which the Street and Traffic
Fund and the City Plan Fund were established have been
completed and,
WHEREAS, there are balances remaining in said funds which
are unencumbered and uncommitted and,
WHEREAS, certain extraordinary conditions have developed
since the adoption of the existing annual budget so that it is
now necessary to appropriate more money than was appropriated
in the annual budget for the various functions of City govern-
ment to meet extraordinary conditions; and,
WHEREAS, additional funds are needed in Account B -53,
"Refunds, Awards and Indemnities" in the Office of Controller
to satisfy and pay a valid and existing judgment rendered
against the City of South Bend, Indiana in Cause No.. B7456 and
in judgment docket 78, page 68 in the Office of the Clerk of
St. Joseph County, Indiana, now; therefore,
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA:
SECTION I. That the following sums of money be and are
hereby ordered transferred to the General Fund of the City of
South Bend, Indiana;
1. 031,394.36 from the Street and Traffic Fund.
2. $23,042.60 from the City Plan Fund.
SECTION II. Be it further ordained that the sum of
$48,000.00 be and the same is hereby appropriated from the
General Fund to Account B -53, "Refunds, Awards and Indemnities"
in the Office of Controller.
SECTION III. This Ordinance shall be in full force and
effect from and after its passage by the Common Council, its
approval by the Mayor, legal publication and the fulfillment
of all statutory requirements of emergency appropriations.
