Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same is hereby amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: The West Thirty three and Fifty three One Hundredths (33.53) Feet off of the entire length North and South of Lot Numbered Twenty nine (29) as shown on the recorded Plat of A. Dosmann to zone from "C" Commercial, "D" Height and Area to "A" Residential, "D" Height and Area, property located at 1317 Lincolnway West, City of South Bend - APC #2076-01 Dear Council Members: The above referenced ordinance of Susan M. Dosmann was legally advertised on July 5,.2001. The Area Plan Commission at its public hearing on July 17, 2001, took the following action: Upon a motion by John DeLee, being seconded by Phil Sutton and unanimously carried, the proposed ordinance of Susan M. Dosmann to zone from "C" Commercial, "D" Height and Area to "A" Residential, "D" Height and Area, property located at 1317 Lincolnway West, City of South Bend is sent to the Common Council with a favorable recommendation. The proposed rezoningg to "A" Residential, "D" height and area represents a downzoning, and will be more compatible with residential housing to the north and east than the commercial uses that could be developed under the existing "C" Commercial zoning. The proposed zoning and use is also consistent with the land use and zoning plans that are being formulated by the Land Use and Appearance Subcommittee of the Lincolnway West Steering Committee. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Dosmann 2076-01 Location: 1317 Lincolnway West City of South Bend STAFF REPORT July 9, 2001 REQUESTED ACTION: The petitioners are requesting a zone change from "C" Commercial, "D" Height and Area to "A" Residential, "D" Height and Area to allow single-family residential. EXISTING LAND USE: The property currently contains a residential structure. SURROUNDING LAND USE AND ZONING: Located to the north are single-family homes zoned "A" Residential, "B" height and area; to the east are single-family homes zoned "C" Commercial, "D" height and area; to the south across Lincolnway West is a church and a commercial business zoned "C" Commercial, "D" height and area; and to the west is a commercial business zoned "C" Commercial, "D" height and area. ACCESS: Access to the site is from Lincolnway West. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site. DRAINAGE: The drainage has not been addressed by the petitioner. SITE DATA: The total site to be rezoned is 4,370 square feet. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, flood hazards, wetlands or environmental hazard areas are present. SITE PLAN: A site plan is not required for rezonings to "A" Residential. AGENCY COMMENTS• PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation.
