AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE
NO. 3702 AS HERETOFORE AMENDED AND SUPPLEMENTED AND THE
MUNICIPAL CODE OF SOUTH BEND, INDIANA CHAPTER 40, ET SEQ.,
AS AMENDED AND SUPPLEMENTED AND ADOPTED BY THE COMMON COUNCIL
BY ORDINANCE NO. 4608 -63
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
SECTION 1. THAT ZONING ORDINANCE NO. 3702 AS HERETOFORE AMENDED
AND SUPPLEMENTED AND THE MUNICIPAL CODE OF SOUTH BEND, INDIANA
CHAPTER 40, ET. SEQ., AS HERETOFORE AMENDED AND SUPPLEMENTED
BE AND THE SAME IS HEREBY AMENDED AND SUPPLEMENTED BY ZONING AS
B, RESIDENTIAL AND A HEIGHT AND AREA DISTRICT.
THE FOLLOWING DESCRIBED PROPERTY:
LOT #l, WOODED ESTATES, SOUTH BEND, IND.
SECTION 11. THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM
AND AFTER ITS PASSAGE BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, APPROVAL BY THE MAYOR OF THE CITY OF SOUTH
BEND, INDIANA, AND LEGAL PUBLICATION.

The attached rezoning petition was legally advertised
under date of December 9 and 16 and given public hearing
on December 19, 1967. The following action was taken:
After due consideration it was moved,
seconded, and unanimously carried that
the ordinance and site development plan
be recommended favorably to the Common
Council.
Excerpts from the minutes of the Area Plan Commission
meeting are hereby made a part of this report.

EXCERPTS FROM THE MINUTES OF THE AREA PLAN COMMISSION
MEETING OF DECEMBER 19, 1967
A proposed ordinance and site development plan of David
Kessler to rezone from "A" Residential Use and "A" Height
and Area District to "B" Residential Use and "A" Height
and Area District thepronerty at 1323 N. Ironwood Drive.
The petitioner appeared and described the surrounding
property and the property involved. He stated that if
his rezoning is granted he will operate a real estate
and insurance office on the property. He will provide
parking in the rear of the property and would also propose
toenclose a carport.
Mr. Kessler indicated that he had talked to the neighbors
and that they appeared to have no objections to his proposal
He also stated that he would retain the existing character
of the house so that it would not detract from the neighborhood.
In response to a question from the plan commission staff,
Mr. Kessler indicated that if the rezoning is granted no
one would reside:;in the dwelling.

No one further appeared either for or against the petition.
After discussion of the following points, it was moved
by Mr. Taylor, seconded by Mr. Lehman and unanimously
carried that the ordinance and site development plan be
recommended favorably to the Common Council;
1. The rezoning of this lot to "B" would be a first step
toward creating a buffer zone between the commercial uses and
the residential uses.
2. "B" zoning of this lot would help to stop the encroachment
of commercial zoning along Ironwood.
3. The house, since it is immediately adjacent to Eddie's
parking lot, is somewhat undesirable for residential use.
