AN ORDINANCE AMENDING CHAPTER 40 OF ORDINANCE.
NUMBER 4608 -63 COMMONLY KNOWN AS THE MUNICIPAL
CODE OF THE CITY OF SOUTH BEND, INDIANA, AS
AMENDED
BE IT ORDAINED BY THE COMMON'COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA THAT:
Section 1.
Chapter 40 of Ordinance Number 3608 -63 adopted by the
Common Council of the City of South Bend, Indiana, on the
14th day of October, 1963, and commonly known as the
Municipal Code of South Bend, Indiana, be and the same is
hereby amended as follows, to wit:
The zoning of the following described real estate,
which real estate was recently annexed to the City, shall
be "A" Residential Use and "A" Height and Area District:
Part of the Northwest Quarter aAd,the Southwest Quarter
of Section 310 Township 37 North, Range 3 East, more
particularly described as follows:
Commencing at the Northeast corner of Northwest One
Quarter of said Section 319 Township 37 'North,
Range 3 East; thence Southerly along the North -South
centerline of said Section 31, 2371.72 feet to the
Point of Beginning; thence South 001 18' 35" East,
295.37 feet; thence 229.74 feet Southeasterly along
the arc of a curve concave to the Northeast, having
a radius of 500.00 feet, a central angle of 26° 19' 36"
and a chord of 227.73 feet; thence South 63° 21' 49"
West, 134.88 feet; thence South 350 46' 04" East,

of Section 31 (also the centerline of Kern Road); thence
North 89° 52' 14" West, 926.83 feet along said South
line of Section 31 to the Point of Beginning.
Section 2.
This Ordinance shall be in full force and effect from
and after its enactment, approval by the Mayor and legal
publication.

The attached ordinance originated by the Area Plan Commission
to zone recently annexed property was legally advertised
under date of November 9 and 16 and given public hearing
on November 19, 1968. The following action was taken:
After due consideration it was duly moved,
seconded, and unanimously carried that the
ordinance be recommended favorably to the
Common Council.
Attached hereto and made a part of this report is an excerpt
from the minutes of the meeting.
