An Ordinance affecting a tract of land 120 feet by 165 feet on the
West side of North Michigan Street beginning 60 feet North of the
intersection of Michigan and Bartlett Streets in the City of South
Bend, Indiana.
ORDINANCE NO. 4999 -68
An Ordinance Amending and Supplementing
Chapter 0 of the Municipal Code
of South Bend, Indiana.
Be it enacted by the Common Council of the City of South
Bend, Indiana, that:
Section 1 - Chapter 40 of the Municipal Code of South Bend,
Indiana (South Bend City Zoning Ordinance No. 3702) be, and the same
is hereby amended, supplemented, and changed in Section 40 -14 (Section
2 of Ordinance No. 3702), and Section 40 -24 (Section 9 of Ordinance
No. 3702) thereof to provide that the following described real estate
located in the City of South Bend, Indiana, to -wit:
Lots Numbered 17 and 18 in Bartlett's
First Addition to the City of South
Bend, in St. Joseph County, Indiana.
be and the same hereby is changed in its Use District regulation
classification from 11C -1" Commercial District to "C" Commercial
District, and from "B" Height and Area District to "F" Height and
Area District, subject to, and in accordance with the site develop-
ment plan as submitted with the petition to amend, as filed by Carl
and Lois Kuespert, Nicholas and Dema Simeri, and Patrick and Josephine
Simeri.

Section 2 - This ordinance is to be in full force and effect
from and after its enactment, the approval of the Mayor, and its
publication according to law.
Section 3 - All prior ordinance affecting the above des-
cribed tract of land in conflict herewith are repealed.

The attached rezoning petition of Carl Kuespert, et al,
was legally advertised under date of February 10 and 17
and given public hearing on February 20, 1968. The
following action was taken:
After due consideration it was moved,
seconded and unanimously carried that
the ordinance and site development plan
be recommended favorably to the Common
Council.
The attached excerpts from the minutes of the meeting are
hereby attached and made a part of this report.
