ORDINANCE NO. 5008 -68
AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION
TO ACCOUNT Z -13, "OTHER COMPENSATION" IN THE
AMOUNT OF $3,182.29 AND THE TRANSFER OF SAME
FROM ACCOUNT Z -531, "PENSIONS TO RETIRED
POLICEMEN ", ALL IN THE POLICEMAN'S PENSION
FUND.
WHEREAS, Certain extraordinary conditions have de-
veloped since the adoption of the existing annual budget so
that it is now necessary to appropriate more money than was
appropriated in the annual budget for the various functions of
City Government to meet such extraordinary conditions; and,
WHEREAS, Additional funds are needed for legal services
rendered by the attorney for the Board of Trustees of the
Police Pension Fund in defense of Cause # C -5049 in St.
Joseph Superior Court and thereby assuring the Department's
ability to properly perform its functions.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA:
SECTION I. That the sum of $3,182.29 be transferred
from Account Z -531, "Pensions to Retired Policemen ", and
transferred and appropriated to Account Z -13, "Other Com-
pensation", both Accounts being within the Policeman's
Pension Fund.
SECTION II. This Ordinance shall be in full force and
effect from and after its passage by the Common Council, its
approval by the Mayor, legal publication and the fulfillment
of all statutory requirements of emergency appropriations.

Reference: Transfer of Ands
Dear Mr. Bickel:
This letter is in reference to the statement received from the Po'_ica
Pension rind attorney George Sands in reference to the suit against
the Board of Trustees of the Police Pension Fluid of the City of South
Bend by the retired pensioners.
Mr. George Sands represented the Pension Board and submitted for h-s
legal services a statement in the amount of $3,182.29.
In last years budget submittance, there was no account set up to cover
such an expense. The account number for such services is Z -13. In
order to meet the obligation of the bill, money will have to be trans-
ferred into this account.
After computing Account Z -531, it is found by the secretary that there
is sufficient amount that can be transferred to cover this bill. This
figure is computed from the retired officers pension which were included
in the budget but have not retired, thus accumulating for the first five
(5) months.
It is suggested that $3,182.29 be transferred from Police Pension Account
Z -531 to open Account Z -13 to meet the obligation of the board to our
Legal Counsellor Mr. George Sands.
This action was voted on and approved unanimously at the Pension Board
meeting of May 14, 1968, the board directing the secretary to submit. this
letter of transfer of funds.
