ORDINANCE 5011 -68
AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE
CITY LIMITS OF SOUTH BEND, INDIANA CERTAIN LANDS
AND PROVIDING, AFTER ANNEXATION SHALL TAKE EFFECT,
THAT FOR A PERIOD OF THREE YEARS, ONE HALF (1/2)
OF THE MUNICIPAL PROPERTY TAXES TO BE IMPOSED UPON
THE ANNEXED TERRITORY SHALL BE IMPOUNDED AND PLACED
IN A SPECIAL FUND SOLELY FOR THE BENEFIT OF THE
ANNEXED TERRITORY.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
SECTION 1: That the following described property in St. Joseph
County, State of Indiana, is hereby annexed to and brought within
the City of South Bend, Indiana:
Beginning at the northeast corner of Section 36, Township 37
North, Range 2 East; thence east forty (40) feet; thence
south along a line forty (40) feet east of and parallel to
the west line of Section 31, Township 37 North, Range 3 East,
to the northwest corner of Lot No. 4 Fairfax Estates 1st
Section, said point being the City Limits line; thence west
along said City Limits line forty (40) feet to the west line
of said Section 31; thence south along said west line of
Section 31 to the north line of Crest Manor Section One
projected west; thence east along the City Limits line, being
the north line of Crest Manor Section One, Two and Three, to
the northeast corner of Lot No. 177, Crest Manor Section Three;
thence south along the City Limits line, being the east line
of Crest Manor Section Three, to the northwest corner of Lot
No. 104 Crest Manor Section Five; thence east along the City
Limits line, being the north line of Lots Nos. 104, 103 and
102 Crest Manor Section Five, to the northwest corner Lot
No. 82 Crest Manor Section Six; thence southeasterly along the
northerly line of said Lot No. 82 to the southwest corner
Lot No. 81 Crest Manor Section Six; thence northeasterly along
the westerly line of Lots Nos. 81 and 80 Crest Manor Section
Six, being the City Limits line to the northerly corner of
said Lot No. 80; thence southeasterly along the City Limits
line, being the easterly line of Lot No. 80 and Lot No. 213
in Crest Manor Section Six; thence southwesterly and southerly
along the southerly and easterly line of Lots No. 213 through
No. 205 inclusive in Crest Manor Section Six to the east line
of Gotham Drive; thence south along the east line of Gotham
Drive and said east line projected to the northwest corner of
Lot No. 123 Kensington Farms Subdivision Third Section Part
One; thence east along the north line of said Lot No. 123 to
the northeast corner of said Lot No. 123; thence southerly
along the east line of Kensington Farms Third Section Part
One to the southeast corner of Lot No. 127 in said Section;
thence westerly along the southerly line of Kensington Farms
Subdivision Third Section Part One to the south corner of

west line of Kensington Farms Third Section Part Two; thence
southerly along the west line of said Kensington Farms Third
Section Part Two to the northerly right -of -way line of Kern
Road; thence due south a distance of Two Hundred Ninety (290)
feet to a point Two Hundred fifty (250) feet south of the
north line of Section 6, Township 36 North, Range 3 East,
thence west along a line Two Hundred Fifty (250) feet south
of and parallel to the north line of said Section 6 and said
line project west to a point Two Hundred Fifty (250) feet

Township 37 North, Range 3 East, Section 36, Township 37 North,
Range 2 East, Section 6, Township 36 North, Range 3 East and
Section One, Township 36 North, Range 2 East, County of
St. Joseph, State of Indiana.
,SECTION 2: Be it further ordained by the Common Council of the
City of South Bend, Indiana, that for a period of three (3) years
after annexation shall take effect one -half (1/2) of all municipal
property taxes to be imposed upon the annexed territory shall be
impounded and placed in a special fund solely for the benefit of
such annexed territory, its property owners and inhabitants, in
the extension of municipal services and benefits and the making
of municipal or public improvements in the annexed territory.
SECTION 3: This Ordinance shall be in full force and effect from
and after its
publication.
