HomeMy WebLinkAboutDissolving the Water Works Board of Directors and Transferring such Board's authority to the Board of Public WorksORDINANCE No. 9297-01 Passed by the Common Council of the Ciry of South Bend, Indiana December 10, Attest: Attest: Presented by me to the Mayor of the City of South Bend, Indiana flr~rcmhcr 11 2Q ~.1 Ciry Clerk President of Common Council Ciry Clerk Approved and signed by me December 14, 2001 Mayor 20 01 ORDINANCE NO. ` 2 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, DISSOLVING THE WATER WORKS BOARD OF DIRECTORS AND TRANSFERRING SUCH BOARD'S AUTHORITY TO THE BOARD OF PUBLIC WORKS STATEMENT OF PURPOSE AND INTENT In 1983 this Council acting pursuant to I.C. 8-1.5-4-2 enacted Ordinance No.7235-83 which established a Board of Directors of the South Bend Water Works. It is now in the best interests of the City of South Bend, effective January 1, 2002 to place the South Bend Water Works under the supervision of the Board of Public Works so that the management of the Water Works facility can be done in a streamlined fashion with the other Public Works Departments. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section I. Ordinance No. 7235-83 which established the South Bend Water Works Board of Directors is hereby repealed. Section II. Pursuant to I.C. 8-1.5-3 and 4 the South Bend Board of Public Works shall have control and supervision over the South Bend Water Works Utility. Accordingly, the Board of Public Works shall be given the right to exercise the powers over the Water Works Utility as such powers are described at I.C. 8-1.5-3-1 et seg• Section III. The Board of Public Works shall report annually to the South Bend Common Council on the activities, objectives and budget of the South Bend Water Works at the same time it reports to the Common Council on the activities of all other municipally owned utilities. Section IV. The consolidation of the Water Works Board and Board of Public Works will be consistent with the City of South Bend's policies and strategic direction.
