ORDINANCE N0, 5019 -68
AN ORDINANCE AUTHORIZING THE SALE AND
CONVEYANCE OF THREE PARCELS OF REAL
ESTATE LOCATED IN THE CITY OF SOUTH BEND,
INDIANA, AND OWNED BY THE CITY OF SOUTH
BEND, INDIANA ,_ .
WHEREAS, the Municipal City of South Bend is the owner of the
three hereinafter described parcels of real estate located in the City
of South Bend, St, Joseph County, Indiana, and
WHEREAS, the said parcels of real estate herein described are
conducive to no public use by the Municipal City of South Bend, Indiana,
and in the best interests of said City should be sold,
NON, THEREFORE, be it ordained by the Common Council of the City
of South Bend, Indiana:
SECTION I. That the following described parcels of real estate situate
in the County of St, Joseph, City of South Bend, Indiana, and owned by
said City, to -wit:

Parcel 1
A part of Bank Out Lot No, 34 of the first Plat of Out lots
of the Town, now City of South Bend, bounded and described
as follows, to wit: Beginning at the Northeast corner of said
lot; thence running West on the North line thereof 100 feet;
thence South 150 feet; thence East 100 feet to the East line
of said lot; thence North along the East line thereof 150 feet
to the place of beginning.
Parcel 2
Fifty (50) foot former Right -of -Way of the Northern Indiana
Railway Inc, extending from the North line of Pokagon Street
North to the South line of Angela Boulevard, and being part of
the Northwest Quarter (4) of the Northwest Quarter (4) of Sec-
tion 1, Township 37 North, Range 2 East, which lies immediately
East of and adjacent to the Alichigan Central Railroad Company °s
Right -of -Way lying South of Angela Boulevard and North of Poka-
gon Street,
Parcel 3
A portion of land in the Wenger and Kreighbaum's Vistula Avenue
Addition consisting of Lots F and G and the Eastern portion of
Lot E described as follows: Beginning at a point of the inter-
section at the Northwest side of an alley and the Southwest line
of Lincoln Way East in the City of South Bend, said point being
the Southeast corner of Lot G in aforesaid Addition'running thence
in a Northwesterly direction about One Hundred 'iNienty -five (125)
feet more or less to the Southeasterly corner of Lot V on said

Plat; thence Southwesterly Thirty (30) feet along the South line
of said Lot V to the Southwest corner of said Lot V; thence North-
westerly along the West line of said Lot V Fifty (50) feet more or
less to the center line of Buirman Ditch; thence in a Southwesterly
direction following the center line of said Ditch to the inter-
section of the West line of Lot E; thence in a Southeasterly dir-
ection along the Southwest ends of Lots E, F and G to the South
line of Lot G, being the Northwest line of above mentioned alley;
thence in a Northeasterly direction along the Southeast line of
Lot G to the place of beginning, all as shovrn in Plat Book 9,
page 100 in the Office of the Recorder of St. Joseph County, Ind-
iana.
shall be sold pursuant to the authority of the Acts of the Indiana General
Assembly for 1905, Chapter 129, Section 53, page 219, the 50th Clause and
pursuant to such authority the City is authorized to, and shall, petition
the Judge of the Circuit Court of St. Joseph County to appoint three dis-
interested freeholders of the City of South Bend, Indiana, to appraise
each of said parcels of real estate and each of said parcels of real es-
tate shall be sold for not less than such respective appraised value of
each.
SECTION II. The b;,ayor of the City of South Bend is hereb; directed and
authorized in the name of the City of South Bend to execute any and all
necessary instruments to accomplish the conveyance of each of said parcels
of real estate and the City Clerk is directed and authorized to attest any
such instruments and affix the seal of the City thereto.
SECTION III. This Ordinance shall be in full force and effect upon its
passage by the Common Council by a vote of not less than tyro- thirds of the
members of said Council and its signature by the Mayor.
