AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND
AMENDING ORDINANCE N0.9258-01 TO APPROPRIATE AN ADDITIONAL
$3,736.09 FROM HALL OF FAME OPERATIONS FUND (#677) AND AN ADDITIONAL
$122,802 FROM COLLEGE FOOTBALL HALL OF FAME FUND (#377) TO SATISFY
THE CITY'S OBLIGATION TO THE NATIONAL FOOTBALL FOUNDATION
STATEMENT OF PURPOSE AND INTENT
On September 10, 2001 this Council approved Ordinance No. 9258-01 which appropriated
$484,088.97 from College Football Hall of Fame Operations Fund (#677) for disbursement to the
National Football Foundation and which appropriated an additional $442,198 from Hall of Fame
Fund (#377), also for the purpose of paying the City's obligation to the National Football
Foundation. A copy of Ordinance No. 925 8-01 is attached hereto and incorporated herein as Exhibit
"A" by reference.
Ordinance No.9258-01 was filed for first reading on August 27, 2001, and thereafter the City
Administration prepared a replacement Ordinance containing revised, updated dollar figures and
information, a copy of which is attached hereto as Exhibit "B." However, the Council has now
learned that Ordinance "B" was not the Ordinance adopted by the Council on September 10, 2001.
It is necessary to amend Ordinance No. 9258-01 to reflect the information, data, and dollar
amounts set forth in Exhibit "B" hereto.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND AS FOLLOWS:
Section I. Ordinance No.9258-01 which was passed by this Council on September 10, 2001
is hereby amended to reflect the data and dollar figures set forth in Exhibit "B" hereto which was
intended as a replacement Ordinance to No. 9258-01.
Section II. The additional sum of $3,736.09 is hereby appropriated and shall be set apart
from and within the Hall of Fame Operations Fund (#677) for disbursement to the National Football
Foundation (NFF) to reflect the difference between the dollar appropriations figures in Exhibits "A"
and "B" hereto.
Section III. The additional sum of $122,802 is hereby appropriated and ordered set apart
from and within College Football Hall of Fame Fund (#377) for purposes of paying remaining
expenses of the Hall of Fame through calendar year 2001 and for use by the NFF in its assumption
of the management of the Hall of Fame to reflect the difference between the dollar appropriation
figures in Exhibits "A" and "B" hereto.
Section IV. This Ordinance shall be in full force and effect from and after the date
of its passage by the common Council, and approval by the Mayor.

Re: An Ordinance Appropriating Additional Funds From Hall of Fame Operations Fund # 677 and
From Hall of Fame Fund #377
Dear Ms. Pfeifer:
On September 10, 2001, the South Bend Common Council approved Ordinance #9258-01
which appropriated $484,088.97 from the College Football Hall of Fame Operations Fund (#677) and
an additional $442,198.00 from Hall of Fame Fund (#377). Both appropriations were for the purpose
of paying the City's contractual obligation to the National Football Foundation. The Council was
provided with a copy of the National Football Foundation contract with the City.
It has come to our attention that the Ordinance which the Council approved and passed on
September 10, 2001 was not the final, intended version of the Ordinance. Our Department had been
working on the National Football Foundation appropriations ordinance since early July, but due to the
delay in securing NFF approval for the contract, additional time passed and the original figures were
no longer valid. Ordinance 9258-01 contained the original figures and was the version filed for first
reading. We believe we replaced it with a revised version. However, the Clerk's office has no record
of the replacement. The error is regrettable, and frankly, we are not certain how it occurred. The
result, however, is that an additional appropriation for the Hall of Fame is now required.
Accordingly, the attached ordinance serves to appropriate an additional $3,763.09 from the
Hall of Fame Operations Fund (#677) and an additional $122,802.00 from College Football Hall of
Fame Fund (#377).
We regret any inconvenience to the Common Council which may be caused by the mixup. We
will make every effort to assure that this does not occur again. Either Thomas Skarbek or Liz Rowe
from the Controller's Office will make the necessary presentation to the Council on this matter and
-will answer any questions that you may have.
