THEODORE NOELL ATTORNEY AT LAW LAFAYETTE BUILDING SOUTH BEND, IND. 46601 ORDINANCE NO. 5033 -68 AN ORDINANCE PROVIDING FOR THE RECEIVING AND CONVEYING OF A GIFT OF REAL PROPERTY TO THE CITY OF SOUTH BEND, INDIANA. WHEREAS, Herschel W. Keefer and Frances Keefer, husband and wife, are the owners in fee simple of Lots 1, 2, 3 and 4 of Mary M. Martin's Addition to the City of South Bend, and WHEREAS, said Herschel W. Keefer and Frances Keefer desire to make a gift of the aforesaid real property to the City of South Bend for the purpose of creating a neighborhood park and /or retention basin to control flood conditions in the area, and WHEREAS, the Common Council of the City of South Bend is authorized to enact ordinances by the Acts of 1905, Chapter 129, Section 53, Clause 6, as shown in Burns Section 48 -1407 to receive gifts, donations, bequests, and public trusts and to agree on terms and conditions accompanying same; NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: That the City of South Bend, Indiana, accept a gift of real property from Herschel W. Keefer and Frances Keefer, being that property more particularly described as follows, to -wit: Lots Numbered One (1), Two (2), Three (3), and Four (4), as shown on the recorded plat of Mary M. Martin's Addition to the City of South Bend, Indiana, by a Quit -Claim Deed, subject to taxes, assessments, and restrictions of record, for the purpose of creating a neighborhood recreational area and /or a retention basin to assist in the control of flood conditions in the area.
