ORDINANCE NO. 5120 -69
AN ORDINANCE APPROPRIATING LOCAL ROAD AND STREET
ACCOUNT FUNDS FOR THE FISCAL YEAR ENDING DECEMBER
31, 1969.
WHEREAS, there was enacted during the 1969 Session of the
Indiana General Assembly an Act, Chapter 392 of the Actsof 1969,
making available to cities, towns and counties for engineering,
construction or reconstruction of roads, streets and bridges
under local jurisdiction, certain additional funds to be derived
from the 7th and 8th cents of Indiana motor fuel tax and fuel
use tax and from increases in fees levied under the Motor Vehicle
Act; and
WHEREAS, no appropriation of such funds was included in the
regular 1969 budget for the Civil City of South Bend because said
Act had not yet been passed at the time said budget was prepared
and adopted; and
WHEREAS, under the terms of the said Chapter 392 of the
Acts of 1969, it is necessary for the City of South Bend to
appropriate from other funds available to it an amount equal to
not less than one - fourth of the cost of eligible projects under
said Chapter 392; and
WHEREAS, an emergency exists requiring the appropriation
and expenditure of certain of said funds already received or to
be received before the end of the year 1969.
NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA:
SECTION I. The following sums of money are hereby appro-
priated and ordered set apart out of the Local Road and Street
Fund for engineering, construction and reconstruction of roads,
streets and bridges, eligible for assistance under Chapter 392
of the Acts of 1969, under the jurisdiction of the Civil City of
South Bend, Indiana, as follows:
Services Contractual $167,443.29
SECTION II. The following sums of money are hereby appro-
priated and ordered set apart out of the Contractor's Improve-
ment Fund as a portion of the City of South Bend's share of the
cost of engineering, construction and reconstruction of roads, streets
and bridges referred to in Section I, as follows:
Services Contractual 59,410.68
SECTION III. The following sums of money are hereby re-
appropriated and ordered set apart out of the Cumulative Capital
Improvement Fund as the balance of the City of South Bend's share
of the cost of engineering, construction and reconstruction of
roads, streets and bridges referred to in Section I, as follows:
Services Contractual
19,162.04
SECTION IV. This ordinance shall be in full force and
effect from and after its passage and approval as required by law.
