ORDINANCE NO. 5114 -69
AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY
LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS, AS ARIENDED
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
Section 1:
That the following described property in St. Joseph Cm nty,
State of Indiana, is hereby annexed to and brought within the City of
South Bend, Indiana:
Part of the Southeast Quarter of Section 25,
Township 37 North, Range 2 East, more particularly
described as follows: Beginning at a point on the
East line of said Southeast Quarter of Section 25,
556.45 feet South of the Northeast corner thereof;
thence continuing South on said East line (being
also the centerline of Miami Highway) a distance
of 173.70 feet; thence West a distance of 370.00
feet to a point; thence North a distance of 173.73
feet to a point; thence East a distance of 370.00
feet to the point of beginning; said real estate
containing approximately 1.476 acres, subject to
legal highways.

Section`S,
This Ordinance shall be in full force and effect from and
after its enactment, approval by the Mayor and legal publication.

Section 2:
Ordinance No. 4913 -67 is hereby amended by deleting from
the area sought to be annexed by said Ordinance, the area being
annexed by this Ordinance.

PETITION FOR ANNEXATION OF
CERTAIN PROPERTY TO THE CITY
OF SOUTH BEND, INDIANA<
TO THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA:
The undersigned hereby respectfully petition your Honorable)
Body to annex to and bring within the City of South Bend, Indiana,
the following described property located in St. Joseph County, State
of Indiana, which is contiguous to lands now within the City, to wit:i
Part of the Southeast Quarter of Section
25, Township 37 North, Range 2 East, more parti-
cularly described as follows: Beginning at a
Point on the East line of said Southeast Quarter
of Section 25, 556.45 feet South of the Northeast
corner thereof; thence continuing South on said
East line (being also the centerline of Miami
Highway) a distance of 173.70 feet; thence West
a distance of 370.00 feet to a point; thence North
a distance of 173.73 feet to a point; thence East
a distance of 370.00 feet to the point of begin-
ning; said real estate containing approximately
1.476 acres, subject to legal highways.
The undersigned constitute the owners in fee simple of one
hundred percent (100 %) of said real estate and respectfully request
that said real estate be annexed to the City of South Bend, Indiana.
The undersigned contend that this annexation is in the
best interests of the City of South Bend, Indiana and of said real
,estate, and that the area is urban in character being an economic andll
social part of the City of South Bend, that the provisions of the
proposed ordinance attached hereto annexing said real estate are fair!
!'and just, that the City is financially able to provide municipal
services to the annexed area within the reasonably near future, that 1 I
the area sought to be annexed, being undeveloped, is needed for the
development of the City in the reasonably near future, that the lines',
of the annexation are so drawn as to form a compact area abutting
said City, and that the requested annexation will broaden the tax
base of said City and will do no harm to the surrounding area.
The following documents accompany this petition: "an
appropriate ordinance annexing the above described real estate to the
City of South Bend, Indiana, which ordinance is attached hereto and
made a part hereof as Exhibit "2 ".

WHEREFORE, the undersigned respectfully request that the
J Common Council refer this matter to the Area Plan Commission and

that after hearings thereon the appropriate ordinance attached hereto
as Exhibit "2" be enacted annexing the above described real estate

to the City of South Bend, Indiana, and for all other proper relief
in the premises.
