AS AMENDED. � �_l r� U N P -rl •,i • i N O 9 w 04 4) r u ro -P WHEREAS, there was enacted by the 1969 Indiana General Assembly, a) ro 0 u N an act concerning the removal and disposal of abandoned junk vehicles in Z10 P a) 0 cities of the first and second class and prescribing penalties, to be known o ro u 10 H H 0 as the Abandoned Vehicle Act, which act provides for the disposal of aband- w 44 *1 oned or junk vehicles which are discarded or otherwise permitted to remain o -u in any place where they are visible from a public place or right -of -way in 0 s4 0 M m cities of the first and second class. a) w : •.q M P 9 o o � WHEREAS, said act provides in Section 4(i) thereof that the Common Q 0 ¢ ¢ p, Council shall denominate the department of city government to be given the .H 010 '1 local responsibility for the removal, storage and disposal of abandoned rnr. m>1 `o ro I +' vehicles. 0 w U a) N O m 0 W o >,.Q) 04 WHEREAS said act provides in Section 18 thereof that there is � P o to be created, a revolving fund to be known as "The Junk Vehicle Fund" and u ro-P r; the Common Council shall annually appropriate sufficient tax monies to said H04: N fund in order to provide an adequate junk vehicle fund. 0 4J U U U7 m N NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY w o 0 w 0 OF SOUTH BEND, INDIANA; o -P 0 S u b,,q•H SECTION I. The Board of Public Works and Safety is hereby denom- inated as the department of city government to be responsible for the removal, 0 0 0 m A storage and disposal of abandoned vehicles within the meaning -i-� a ro a g p ng and purposes of 0w o ow the Abandoned Vehicle Act enacted by the 1969 Indiana General Assembly. ,r. 0 4J P, o SECTION II. There is hereby created a revolving fund to be known u a) a�i.N rd as "The Junk Vehicle Fund" into which the annual tax levy to provide funds y w < p ro for the purposes of administering the Abandoned Vehicle Act shall be depos- ited. Said fund shall be appropriated and used solely for the purposes enum- a) a) R,•a 0 erated in the Abandoned Vehicle Act. All monies remaining in said fund at 3 -P v m 4J the end of each year shall remain in such fund and not revert to the General Fund. SECTION III IV ~ SECTION••, This ordinance shall be in full force and effect H from and after its passage by the Common Council, its approval by the Mayor and the fulfillment of all statutory requirements.
