ORDINANCE NO. 5077 -69
AN ORDINANCE AMENDING SECTIONS 40 -27
AND 40 -28 OF THE MUNICIPAL CODE OF THE
CITY OF SOUTH BEND, INDIANA, 1962, AS
AMENDED, ALSO KNOWN AS SECTIONS 10 AND
11 OF ORDINANCE NO. 4990, THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND,
INDIANA, AS AMENDED
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
Section 1:
That Section 40- 27 -(e) and 40- 28 -(e) of the Municipal
Code of the City of South Bend, Indiana, 1962, as amended,
also known as Sections 10 and 11, Lots Recorded After
June 13, 19499 of Ordinance No. 4990, the Zoning Ordinance of
the City of South Bend, Indiana, as amended, is hereby amended
so that same shall be and read as follows:
(e) LOTS RECORDED AFTER JUNE 13, 1949. On any lot
50 feet or more in width at the building line and recorded
after June 13, 1949 there shall be two side yards which shall
have a minimum combined width of 20 percent of the lot width
at the building line oi" 12 feet, whichever is the greater; the
smaller of the two side yards shall be not less than 10 per cent
of the total lot width or 6 feet whichever is the greater.
Section 2:
This Ordinance shall be in full force and effect from
and after its enactment, approval by the Mayor and legal
publication.

to whom was referred An Ordinance amending Sections 40 -27 and 40 -28
of the Municipal Code of the City of South Bend,
Indiana, 1962, as amended, also known as Sections
10 and 11 of Ordinance of 4990, the Zoning Ordinance
of the City of South Bend, Indiana, as amended.
Respectfully report that they have examined the matter and that in their opinion
The ordinance should remain as presented to the ordinance
committee and is recommended favorably to the Common Council.
It should be noted that the Ordinance was reviewed and favor-
ably recommended by the Area Plan Commission to the Common
Council at its meeting of March 18, 1969.

Gentlemen:
The attached ordinance amending Sections 40 -27 and 40 -28
of the Municipal Code of the City of South Bend, Indiana
was legally advertised under date of March 8 and 15 and
given public hearing on March 18, 1969. The following
action; was taken:
After due consideration it was moved, seconded,
and carried that the ordinance be recommended
favorably to the Common Council.
Attached hereto and made a part of this report is an excerpt
from the minutes of the meeting.
