AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT THE INTERSECTION OF
AMERITECH DRIVE AND PARKLAND DRIVE ,
IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of South Bend, Indiana:
SECTION I. Ordinance No. 4990-68, as amended, which ordinance is commonly known
as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended
in order that the zoning classification of the following described real estate in the City of South
Bend, St. Joseph County, State of Indiana:
Lot 9, U.S. 31 Industrial Park, Section 2
Lot 10, U.S.31 Industrial Park, Section 2
Lot 11, U.S.31 Industrial Park, Section 4
Lot 12, U.S.31 Industrial Park, Section 4
Lot 13, U.S.31 Industrial Park, Section 4
be and the same is hereby established as "D" Light Industrial - "a".
SECTION II. This ordinance shall be in full force and effect from and after its passage by
the Common Council, approval by the mayor, and legal publication.

RE: A pproposed ordinance initiated by the Common Council, City of South Bend to zone
from "IP" Industrial Park to "D" Light Industrial, "A" Height and Area, property located
at the intersection of Ameritech Drive and Parkland Drive, Lots 9, and 10 of U.S. 31
Industrial Park, Section 2, and Lots 11, 12,, and 13 of U.S. 31 Industrial Park, Section 4,

Dear Council Members:
The above referenced ordinance initiated by the Common Council was legally advertised
on June 6, 2002. The Area Plan Commission at its public hearing on June 18, 2002, took
the following action:
Upon a motion by Charlotte Sobel,, being seconded by Robert Hawle and unanimousl
carried, the~ pproposed ordinance initiated by the Common Council, ~ity of South Ben~to
zone from "IP" Industrial Park to "D" Light Industrial, "A" Height and Area, proper~t~~
located at the intersection of Ameritech Drive and Parkland Drive, Lots 9, and 10 of U.S.
31 Industrial Park, Section 2, and Lots 11, 12, and 13 of U.S. 31 Industrial Park, Section
4 City of South Bend is sent to the Common Council with a favorable recommendation.
V~ithin the immediate area there are other properties that are currently zoned "D" Light
Industrial and therefore it is the Commission's opinion that the proposed zoning and
allowable uses within the "D" Light Industrial Zoning District are reasonable for these
properties.
T'he deliberations of the Area Plan Commission and points considered in arriving at the
above decision are shown in the minutes of the public hearing, and will be forwarded to
you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the Area Plan
Cotmission's Staff Report.

Park, Section 2, and Lots 11, 12, and 13
of U.S. 31 Industrial Park Section 4
City of South Bend
RE UESTED ACTION: The petitioners are requesting a zone change
from "IP" Industrial Park to "D° Light
Industrial, "A" Height and Area to allow all
uses permitted within the "D" Light Industrial
Zoning Classification.
EXISTING LAND USE: The property is currently vacant land.
SURROUNDING LAND USE AND ZONING: Located to the north is agricultural land
zoned "R" Residential in the County; to the
east are industrial businesses zoned "IP"
Industrial Park and "D" Light Industrial, "A"
height and area; to the south is an industrial
business zoned "IP" Industrial Park; and to
the west is the U.S. 31 Bypass.
ACCESS• Access to the site is from both Ameritech
Drive and Parkland Drive.
WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site.
DRAINAGE: The drainage has not been addressed by the
petitioner.
SITE DATA• The total site to be rezoned is 17 acres.
ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no
public wells, flood hazards, wetlands or
environmental hazard areas are present.
SITE PLAN• A site plan is not required for rezonings
initiated by the Common Council.
AGENCY COMMENTS:
PRELIMINARY
STAFF RECOMMENDATION: Based on information available prior to the
public hearing, the staff recommends that this
petition be sent to the Common Council with a
favorable recommendation. Within the
` immediate area there are other properties that
are currently zoned "D" Light Industrial and
therefore it is the staff's opinion that the
proposed zoning and allowable uses within the
"D" Light Industrial Zoning District are
reasonable for these properties.
