AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA AMENDING ARTICLE 6, SECTION 17-49 OF THE SOUTH BEND
MUNICIPAL CODE TO DELETE SHUTOFF VALVE REPAIR
STATEMENT OF PURPOSE AND INTENT
Article 6, Section 17-49 of the South Bend Municipal Code imposes a service charge of
$1.50 per month for all water users which is then deposited into the Water Leak Insurance Fund
(#644). This Code Section originally applied the service charge revenue to costs for repair ofwater
service lines, and not to shutoff valves. Use of the service charge revenue for repair and replacement
ofwater shutoff valves was added by amendment to Section 17-49 in the 1980's. Elimination of
water shutoff valve replacement and service costs from the Water Leak Insurance Fund will stabilize
the Water Leak Insurance Fund established by Article 6, Section 17-49 and prevent an increase in
rates because the cost of repairing and replacing water shutoff valves has increased and placed
financial strain on the Water Leak Insurance Fund. The water shutoff valve repair/replacement costs
can be absorbed by and paid through the Water Works Operations Fund (#620) as they were done
in the past.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South
Bend as follows:
Section I. Article 6, Section 17-49 of the South Bend Municipal Code shall be and is
amended to read as follows
Sec.17-49. Assessment of charges; deposit in separate fund, purpose.
(a) The sum of one dollar and fifty cents ($1.50) per month shall be added to the
water service charge of all water users.
(b) All of said sums of money so collected shall be deposited in a separate fund of
the Bureau of Water Works and said fund shall be used solely for the repair and/or
replacement of leaking water service lines
Section II. This Ordinance shall be in full force and effect from and after its passage by
the Common Council, and approval by the mayor.

Re: Ordinance eliminating the curb valve from the leak insurance ordinance
The original 1976 ordinance did not include the curb valve replacement, it came into play in the
early eighties when the number of repairs could no longer be handled in house so they were
included in the leak insurance fund.
This ordinance would remove the curb valve from the leak insurance fund. This action would
eliminate the short fall in the fund.
The Water Works would do as many repairs in house as possible and the balance would be paid
out of the revenues. This ordinance will save the fund about $100,000.00 a year and keep it in a
positive position for as many as three to five years before it would need to be revisited. At this
time it will eliminate a need for a rate increase.
We are making a number of changes in the utility that will free up the money needed to cover the
cost.
We will make ourselves available to answer any questions you might have on the ordinance.
