WHEREAS, there was enacted during the 1969 Session of the
Indiana General Assembly an Act, Chapter 392 of the Acts of 1969,
making available to cities, towns and counties for engineering,
construction or reconstruction of roads, streets and bridges
under local jurisdiction, certain additional funds to be derived
from the 7th and 8th cents of Indiana motor fuel tax and fuel
use tax and from increases in fees levied under the Motor Vehicle
Act; and
WHEREAS, no appropriation of such funds was included in
the regular 1970 budget for the Civil City of South Bend; and
WHEREAS, under the terms of the said Chapter 392 of the
Acts of 1969, it is necessary for the City of South Bend to
appropriate from other funds available to it an amount equal to
not less than one - fourth of the cost of eligible projects under
said Chapter 392; and
WHEREAS, an emergency exists requiring the appropriation
and expenditure of certain of said funds already received or to
be received before the end of the year 1970.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA:
SECTION I. The following sums of money are hereby appro-
priated and ordered set apart out of the Local Road and Street
Fund for engineering, construction and reconstruction of roads,
streets and bridges, eligible for assistance under Chapter 392
of the Acts of 1969, under the jurisdiction of the Civil City of
South Bend, Indiana, as follows:

$67,660.00
SECTION II. The following sums of money are hereby appro-
priated and ordered set apart out of the Cumulative Capital Imp-
rovement Fund as the balance of the City of South Bend's share
of the cost of engineering, construction and reconstruction of
roads, streets and bridges referred to in Section I as follows

SECTION III. This ordinance shall be in full force and
effect from and after its passage and approval as required by law.

Memo to: The South Bend Common Council
Subject: Ordinance appropriating Local Road and Street Funds in
the sum of $67,660, and $22,553 from the Cumulative
Capital Improvement Fund.
EXPLANATION OF SECTION I OF PROPOSED ORDINANCE
The City has made application to the Arterial Road and Street
Board in Indianapolis for 75% of the cost of the following
projects:
1. Vine Street Area Trunk and Lateral Storm Sewer Installation
The property owners on Vine Street from 32nd to 36th Street
have petitioned the Board of Public Works & Safety for paving
of Vine Street under Barrett Law. Before this pavement can be
installed we must first recognize the immediate need of storm
sewers in this area. A drainage study and survey shows that
there should be a storm sewer built in Vine Street with
laterals branching off in both directions into the north and
south alleys. Therefore, the request for this fund for storm
sewers is part of an effort to expedite the construction of
a permanent type pavement in Vine Street. The cost of the
proposed storm sewer installation is as follows:
Vine Street sub -trunk sewer cost - - - $28,285.25
Cost of lateral sewers in alleys - - - 31,980.00

APPLICATION HAS BEEN MADE FOR 75% OF THIS COST - - - $49,718.85
2. Topics Program (Traffic Operations Program for
Increasing Capacity and Safety)
Under this Federally- assisted program the Bureau of
Public Roads will, in cooperation with the local
community, pay 50% of the cost of making improvements
to selected intersections to improve traffic flow and
reduce accidents. Out Transportation Study,under way
by the Area Plan Commission, has identified the problem
intersections.
In order to qualify for the matching Bureau of Public

Roads Funds we must now establish the priorities,
prepare preliminary plans and cost estimates for
improvements to the selected intersections.
The requested funds are for the purpose of employing
the firm of Clyde E. Williams & Associates for the
above purposes. Their fee will be $23,920.00.

EXPLANATION OF SECTION II OF PROPOSED ORDINANCE
This section of the proposed ordinance appropriates
from the Cumulative Capital Improvement Fund the
required 25% participation by a governmental unit
(which is t6cessary in order to apply for 75% of the
costs to the Arterial Road and Street Board).
