ORDINANCE NO. 5177 -70
AN ORDINANCE ANNEXING TERRITORY TO THE
MUNICIPAL CITY OF SOUTH BEND, INDIANA,
GENERALLY DESCRIBED AS THE GILMER PARK
ANNEXATION.
Be it enacted by the Common Council of the City of
South Bend, Indiana that:
Section 1 - the following described land, lying adjacent
to and forming a contiguous boundary with the present City Limits
of the Municipal City of South Bend, Indiana, more particularly
described as:
Beginning at the intersection of the southerly right -of -way
fine of the U.S. #31 South Bend By -Pass and the north and
south centerline of Section 26, T37N, R2E; thence due south
along the said centerline of Section 26, T37N, R2E to the
south line of Section 26, T37N, R2E; thence due west a
distance of 385 feet along the north line of Section 35,
T37N, R2E; thence due south along a line 385 feet west of
and parallel to the north and south centerline of
Section 35, T37N, R2E a distance of 1050 feet; thence due
east a distance of 385 feet to the west boundary line of
Jewelwood Addition; thence due south along the said west
boundary line of Jewelwood Addition,(which line is also
the north and south centerline of Section 35, T37N, R2E),
to the south line of said Section 35, T37N, R2E (this
south line also being the centerline of Kern Road);thence
further due south 200 feet along the north and south center-
line of Section 2, T36N, R2E; thence due east along a line
200 feet south of and parallel to the north line of said
Section 2, T36N, R2E a distance of 2335 feet more or less
to a point 250 feet due west of the centerline of U.S. #31
South; thence southwesterly along a line 250 feet west of
and parallel to the centerline of U.S. #31 a distance of
300 feet more or less to the south boundary line of
Southmoor Addition extended westward; thence east along
this line and following the south boundary line of South -
moor Addition a distance of 1050 feet more or less to a
point of intersection with the west boundary of McCracken's
Rolling Acres Unit "B "; thence south following the west
boundary of McCracken's Rolling Acres Unit "B" a distance
of 686 feet more or less to a point of intersection with
the south line of McCracken's Rolling Acres Unit "B ";
thence east following the south line of McCracken's Rolling
Acres Unit "B" and the south line of McCracken's Rolling
Acres Unit "B" extended eastward a distance of 1220 feet
more or less to the southwest corner of Lot No. 57 in
McCracken's Rolling Acres Unit "C "; thence east a distance
of 1100 feet more or less following the south line of
McCracken's Rolling Acres Unit "C" and the south line of
McCracken's Rolling Acres Unit "C" extended east to a
point 200 feet east of the centerline of Fellows Street
(also being the north and south centerline•of Section 1,
T36N, R2E); thence north following a line 200 feet east
of and.parallel to the centerline of Fellows Street a
distance of 1150 feet more or less to a point on a line
200 feet south of the north section line of Section 1,
T36N, R2E; thence east on a line parallel to and 200 feet
south of the north section line of Section 1, T36N, R2E
a distance of 900 feet more or less to a point in a north
and south line established by the east line of Swanson
Heights Subdivision extended south, thence north along
the east line of Swanson Heights Subdivision a distance
of 1493 feet more or less to a point at the northeast
corner of Lot 18 of Swanson Heights Subdivision; thence
west a distance of 900 feet more or less following a line
formed by the north end of Swanson Heights Subdivision and
the north end of Swanson Heights Subdivision extended west
to a point 200 feet east of the north and south centerline
of Section 36, T37N, R2E; thence north following a line
200 feet east of and parallel to the north and south center-
line of aforesaid Section 36 a distance of 3770 feet more
or less to a point in the south section line of Section 25,
T37N, R2E,(said point being on the present City Limits of
the City of South Bend); thence west; thence north; thence
southwesterly following the present City Limits; thence
further west and northwesterly following the present City
Limits to the place of beginning, all located in Sections
25 and 26, T37N, R2E and Sections35 and 36, T37N, R2E and
Sections 1 and 2, T36N, R2E, all in Centre Township,
St. Joseph County, Indiana, containing approximately
890 acres,
be, and the same hereby is, annexed as a part of the Municipal
City of South Bend, Indiana.
Section 2 - This Ordinance is to be in full force and
effect from and after its enactment, the approval of the Mayor,
and its publication according to law.
