Seely, Jr. 801 Odd Fellows Building South Bend, Indiana 46601 PMPOSEP ORDINANCE N0. 5174 -70 AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, IDENTIFIED AS ORDINANCE NO. 4990, ORDINANCE NO. 3702, AS AMENDED, TO THE EXTENT IT IS STILL EFFECTIVE, AND THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, SECTIONS 40 -1 TO SECTIONS 40 -43, AS AMENDED, TO THE EXTENT IT IS STILL EFFECTIVE BE IT ORDAINED by the Common Council of the City of South Bend, SECTION I. That the following described real estate in the City of South Bend, Indiana, to -wit: A part of the Northeast Quarter of Section 8, Township 37 North, Range 3 East of the Second Principal Meridian, described as follows: Beginning at a point on the West line of the Northeast Quarter of Section 8, 1216.32 feet North (as measured along said West line) of the South- west corner of said Quarter Section; thence North 000 391 5011 East along said West line a distance of 977.70 feet to a point; thence South 890 201 101' East, a dis- tance of 232.00 feet which is the point of beginning of this tract; thence North 000 391 5011 East a distance of 115.18 feet to a point; thence South 890 201 10t1 East a distance of 125.00 feet to a point; thence North 190 071 25" East a distance of 79.06 feet to a point; thence South 000 391 50" West, a distance of 190.18 feet; thence West approximately 150 feet to the point of beginning. be and the same is hereby zoned "B" Residential Use and "B" Height and Area District, the same to conform with the site development plan submitted herein. Dayne Bonta under certain trusts for Ralph and Wanda Williams was legally advertised under date of March 21 and March 28, 1970 and was given public hearing on March 31, 1970. The - following action was taken on March 31, 1970. After due consideration, it was moved, seconded and carried that the ordinance be recommended favorably to the Common Council. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report.
