AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST NORTH/SOUTH ALLEY EAST OF OLIVE STREET FROM ORANGE STREET NORTH TO LIlVDEN AVENUE; THE FIRST NORTH/SOUTH ALLEY WEST OF SADIE STREET FROM ORANGE STREET NORTH TO LINDEN AVENUE; CARLISLE STREET FROM ORANGE STREET NORTH TO LINDEN AVENUE STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: The first North/South alley East of Olive Street from Orange Street North to Linden Avenue for a distance of 386 feet and a width of 12 feet. Being a part of Oak Grove ls` Addition to the City of South Bend, St. Joseph County, Indiana. The first North/South alley West of Sadie Street from Orange Street North to Linden Avenue for a distance of 386 feet and a width of 10 feet. Being a part of Oak Grove 15` Addition to the City of South Bend, St. Joseph County, Indiana. Carlisle Street from Orange Street North to Linden Avenue for a distance of 386 feet and a width of 40 feet. Being a part of Oak Grove 15t Addition to the City of South Bend, St. Joseph County, Indiana. Hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and of the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of--way, unless such rights are released by the individual utilities. SECTION III. The following property maybe injuriously or beneficially affected by such vacating: 18-2022-0655; Civil City of South Bend 18-2022-0656.01; Civil City of South Bend 18-2022-0658; Civil City of South Bend 18-2022-0661 thru 0680; Civil City of South Bend 18-2023-0685; Rose Griffin 18-2023-0687; Tamika Lottie 18-2023-0691; Kimberly Glover 18-2023-0695; Diana Pittman 18-2023-0699; Neighborhood Resources & Technical Services Corp. SECTION IV. The purpose of the vacation of the real property is to consolidate property that is being used by South Bend Fire Station #4, and to prevent general access by the public through Fire Station #4 property. SECTION V. This ordinance shall be passed by the Common Council and be in full force and effect from and after its passage by the Common Council and approval by the Mayor. HUNT EXECUTIVE DIRECTOR March 15, 2002 Mr. Rolland Kelly, President South Bend Common Council 4`'' Floor City-County Building South Bend, IN 46601 Re: Vacation of Carlisle Street and Two Parallel Alleys Dear Mr. Rolland: On behalf of the City of South Bend and the Board of Public Works, I am submitting a Petition and Ordinance for the vacation of a portion of Carlisle Street and two adjacent alleys. These rights-of--way are within the confines of South Bend Fire Station #4. Station #4 was built on a portion of Carlisle Street. One of the alleys bisects the front yard of Station #4, and the other alley borders the east property line of Station #4. Vacation of these rights-of--way will allow the Fire Department to better maintain the property and have greater control over access to and from the property. It will also permit the disposition of some of the northeast and southeast corners of the property to be granted to Habitat for Humanity for the construction of four homes.
