ORDINANCE NO. 5170 -70
AN ORDINANCE AMENDING AND SUPPLEMENTING
ORDINANCE 4990 - CHAPTER 40 OF MUNICIPAL
CODE (Formerly Zoning Ordinance 3702),
AS AMENDED
BE IT ENACTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA THAT:
Section 1:
Ordinance 4990 - Chapter 40 of the Municipal Code
(formerly Zoning Ordinance 3702) of the City of South Bend,
Indiana be and the same is hereby amended, supplemented,
and changed, to provide that the following described
real estate located in the City of South Bend, Indiana,
to wit:
Lot A and Lots 11 21 31 4, and 5 of Murphy First
Addition to the City of South Bend, Indiana.
be and the same hereby is zoned to "B" Residential Use
and "A" Height and Area District in accordance with the
site development plan filed herewith.
Section 2:
This Ordinance is to be in full force and effect
from and after its enactment, approval by the Mayor and
its publication according to law.

The attached ordinance, originated by the Area Plan
Commission, was legally advertised under date of
December 26 and January 3, 1970 and given public
hearing on January 5, 1970. The following action was
taken:
After considerable discussion involving
existing and future land use patterns,
residential density, transportation
facilities and service, it was moved,
seconded, and carried that the ordinance,
subject to the submitted site development
plan, be recommended favorably to the
Common Council. It was also further
recommended that the Council consider
requiring the developer to screen the
ends of his parking areas.
Attached hereto and made a part of this report is an
excerpt from the minutes of the meeting.
