ORDINANCE NO. 5108 -69
AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL
CITY OF SOUTH BEND, INDIANA, WHICH IS COMMONLY
DESCRIBED AS WHITCOMB & KELLER'S APARTMENT
COMPLEX.
Be it enacted by the Common Council of the City of
South Bend, Indiana that:
Section 1 - The following described land, lying adjacent
to and forming a contiguous boundary with the present City Limits
of the Municipal City of South Bend, Indiana, more particularly
described as:
Beginning at a point on the East bank of the St. Joseph
River, which point is 200 feet North of the South line
of Section 35, Township 38 North, Range 2 East, said
point being on the present City Limits of the City of
South Bend, Indiana; thence Northerly and Easterly
along the bank of the said St. Joseph River, being
the City Limits of the City of South Bend, to a point
that is 1,850 feet North of the South line of the said
Section 35; thence East, parallel to said South line
of Section 35 to a point on the West right -of -way line
of the Michigan Central Railroad; thence Southerly and
Westerly along said right -of -way line to a point 200
feet North of the South line of said Section 35, said
point being on the present City Limits of the City of
South Bend; thence Westerly on a line 200 feet North
of the South line of said Section 35 along said City
Limits to the place of beginning.

City of South Bend, Indiana.
Section 2 - This Ordinance is to be in full force and
effect from and after its enactment, the approval of the Mayor,
and its publication according to law.

TO: THE AREA BOARD OF ZONING APPEALS OF ST, JOSEPH COUNTY, INC.
This letter is written and submitted to you as a
commitment on the part of Whitcomb & Keller, Inc. to the early
annexation of the territory involved in our apartment project
to the City of South Bend.
It is our intention to petition for such annexation
when the building permits for the erection of these apartment
facilities have been issued; or in the event that the Common
Council should desire themselves to initiate annexation petitions,
we will cooperate in accomplishing such annexation.
