PRESS ORDINANCE NO. 5136-70 AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, GENERALLY DESCRIBED AS THE FILLMORE ROAD, MAYFLOWER ROAD, PENN CENTRAL, CITY LIMITS ANNEXATION. Be it enacted by the Common Council of the City of South Bend, Indiana that: Section 1 - The following described land, lying adjacent to and forming a contiguous boundary with the present City Limits of the Municipal City of South Bend, Indiana, more particularly described as: Beginning at a point on the northwest corner of the east one -half (1/2) of Section 8, T37N, R2E, said point being on the existing City Limits of the City of South Bend, Indiana, and at the center of the intersection of Mayflower Road and Fillmore Road; thence north following the west line of the east one -half (1/2) of Section 5, T37N, R2E, a distance of 2165 feet more or less to the point of intersection with the north right-of-way line of the New York Central Railroad (Penn Central); thence southeasterly following the north right-of-way line of the said Railroad a distance of 4070 feet more or less to a point of intersection with the west line of the east one -half (1/2) of the southwest one - quarter (1/4) of Section 4, T37N, R2E, said point being on the City Limits of the City of South Bend, Indiana; thence south and west following the City Limits a distance of 5470 feet more or less to the point of beginning. Z4"4 Curlwn January 12, 1970 Memo to: South Bend Common Council Annexation Committee Subject: Proposed Annexation of area generally described as the Fillmore Road, Mayflower Road, Penn Central, City Limits annexation. Statistical Data: , Job No. 69 -05P Description: Bounded on the east by the present City Limits, on the north by the Penn Central right -of -way, on the west by Mayflower Road and on the south by Fillmore Road. Zoning: The area between Clements and Mayflowers Road and south of Nash is zoned residential, the remainder of the area is zoned manufacturing. Size: 90 acres. Residential Units: 63 Educational Uses: none Commercial Uses: none Governmental Uses: local State Highway yards .Industrial Uses: None Residential Population: 221 Miles of Streets: 2.4 miles (2.15 without Mayflower Road Recreation Area: none Total Assessed Valuation: Land: $45,460.00 Improvements:123,060.00 $168,520.00 -- -Total Distribution of State Collected Taxes per capita: M,V.H. The additional cost of furnishing these services to the proposed area are as follows: Police Protection: The number of police officers required for any city is based on the population. Our present ratio being 1.5 police officers per 1000 population, on the basis of 221 residents, the cost for this service (including equipment and patrol car) will be $3315.00. Future development of the area would require more officers; how veer, the increased cost would be offset by the increase in assessed valuation. Fire Protection: The need for fire protection is based on two factors -- the value of the property to be protected and the distance from the responding stations. The area under consideration lies about 1/2 mile north of our present Station #12. This Station will give adequate first response to the fire with backup from Station #4 or #11. Our deficiency in this area exists in the response distance for an aerial company which must now respond from Station #4 at Walnut and Thomas Streets which is about 22 miles from the area. Future plans call for moving the aerial company from Station 04 to Station #12 which would eliminate any deficiency. No additional fire personnel or equipment will be required and we do not believe that this cost of relocating the aerial company should be charged to this area since this deficiency already exists. Streets and Traffic: The City Street and Traffic Departments will maintain all public streets within the area. The present cost of operation and maintenance of the street and traffic departments is $375Q.00 per mile per year, so the additional cost of 2.15 miles of Street would amo nt to $8062,50. Street Lighting: The annual cost of street lighting is approximately $1000 per mile. On the basis of 2.4 miles of street (including May- flower Road) this cost would be $2400.00. Sanitation: Cost to the Sanitation Department for garbage removal for the existing units (at $3.75 per unit per year) would be $236.25 per year. Parks: LaSalle Park Recreation Center which is a short distance away, and the large open area around Lafayette and Washington Schools provide recreational facilities. Additional park services do not seem to be needed, but the cost of parks per capita being $11.00 per year would indicate a cost for service for this area of $2431.00. Water Service: There is a 16" water main along Lexington Ave. extended south to Fillmore Road (this point is where Lombardy inter- sects Fillmore Road from the south). Thereiis a 16" water main along Fillmore Road from Lombardy Drive east. There is an 8" water main along Fillmore Road from Lombardy Drive west for 1100'. Sewer Sezvice: A 10 inch sanitary sewer exists at the intersection of Lombardy and Fillmore, and also at the intersection of Westwood Lane and Fillmore. These two sanitary sewers will provide adequate service to this area. A 12 inch storm sewer also exists the the intersection of Lombardy and Fillmore. With the use of retention basins to collect the immediate runoff water, and using the 12 inch storm sewer only to drain the retention basins over a period of several days, the existing storm facilities should prove to be adequate. COST SUMMARY: Police $3315.00 Fire none Street & Traffic 8062.50 Street Lighting 2400.00 Sanitation 236.25 Parks 2431.00 Water none Sewer none $16,444.75 10% governmental overhead 1,644.50 Total Cost $18,089.25 /per year. It should be pointed out that the above cost summary is based on present conditions. Future development may well increase the cost of rendering services; however, we would preduct a corresponding increase in taxable property. The proposed annexation is within the limits as established by the Area Plan Commission Study of 1966. We believe the annexation to be in the best interest of the City of South Bend. Lloyd S.
