ORDINANCE N0, 5131 -69
AN ORDINANCE AMENDING SECTION 40 OF THE MUNICIPAL
CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, AS
AMENDED, ALSO KNOWN AS ORDINANCE NO. 4990, THE
ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA,
AS AMENDED., AS AMENDED.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
Section 1:
That Section 40 of the Municipal Code of the City of
South Bend, Indiana, 1962, as amended, also known as
Ordinance No. 4990, the Zoning Ordinance of the City of
South Bend, Indiana, be and the same is hereby amended
as follows, to wit:
The following described real estate situated in the
City of South Bend, Indiana and annexed to the City as
part of Ordinance No. 5084 -69 be and the same hereby is
zoned "B" Residential Use and "A" Height and Area District,
conforming to the site development plan attached hereto:
Part of the Southwest Quarter of the Southeast
Quarter Section 31, Township 38 North, Range 3
East, St. Joseph County, Indiana, more particularly
described as follows:
Beginning at a point on the North line of the
said Southwest Quarter of Southeast Quarter
of Section 31, 450.80 feet East of the North-
west corner thereof; thence North 89 degrees
54 minutes 40 seconds East along said North
line a distance of 738.24 feet to a point; thence
South 34 degrees 32 minutes 40 seconds West,
a distance of 275.18 feet to a point; thence
South 55 degrees 27 minutes-20 seconds East,
a distance of 20 feet to a point; thence South
34 degrees 32 minutes 40 seconds West, a
distance of 155.17 feet to a point; thence South
55 degrees 27 minutes 20 seconds East a distance
of 170 feet to a point; thence South 34 degrees
32 minutes 40 seconds West, a distance of 327.35
feet to a point; thence South 55 degrees 27 minutes
20 seconds East, a distance of 130.00 feet to the
Westerly line of Indiana State Road 23 (Edwards-

feet to a point; thence north 00 degrees 01 minute
38 seconds East a distance of 659.36 feet to the
point of beginning. Containing 9.618 acres, more
or less.
Section 2:
That the following described real estate situated
in the City of South Bend, Indiana and annexed to the
city as part of Ordinance No. 5084 -69 be and the same
hereby is zoned "C" Commercial Use and "C" Height and
Area District:
Beginning at the southwest corner of the
intersection of Vaness Street and South
Bend Avenue; thence westerly 360 feet along
the south line of Vaness Street to a point;
thence southerly 265 feet to a point; thence
easterly 300 feet to a point in the west
line of South Bend Avenue; thence north-
easterly 460 feet along the west line of
South Bend Avenue to the point of beginning.
Section 3:
This ordinance shall be in full force and effect
from and after its passage and legal lication.

The attached ordinance originated by the Area Plan
Commission was legally advertised under date of October
11 and 18 and given public hearing on October 21, 1969.
The following action was taken:
It was moved, seconded, and carried that the
ordinance be recommended favorably to the
Common Council.
An excerpt from the minutes of the meeting is hereby
attached and made a part of this report.
