NO. 5151 ==70 AN ORDINANCE AMENDING ORDINANCE NO. 4990 ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA BE IT ORDAINED by the Common Council of the Civil City of South Bend, Indiana: Section 1. That Ordinance No. 4990 adopted by this Common Council more commonly known as the Zoning Ordinance, be amended by the rezoning of a certain parcel of land located in the City of South Bend, County of St.Joseph, State of Indiana, known and described as follows, towit: "That part of Lot Numbered 65 as shown on the recorded Plat of Jefferson Heights Addition to the City of South Bend, Indiana, which part is bounded and described as follows: Beginning at a point 154 feet South of the Original North East corner of said Lot No. 65; thence West 130.2 feet to the East line of a public alley; thence South on said East line of the public alley, a distance of 48 feet; thence East 130.2 feet to the West line of Ironwood Drive (which is the East line of said Lot No. 65); thence North along the said West line of Ironwood Drive, a distance of 48 feet to the place of beginning, and being known as Lot Numbered 189 as shown on the Unrecorded Plat of Jefferson Heights Second Addition to said City of South Bend. from "A" Residential Use and "B" Height and Area District to "C" Commercial Use and "D" Height and Area District, and that said Ordinance shall be in effect from and after its passage and legal publication, subject to filed site development plan. Wayne St. 1219)233 -2955 June 24, 1969 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached rezoning petition of the Marathon Oil Company, Inc. was legally advertised under date of June 7 and 14 and given public hearing on June 17, 1969. The following action was taken: After due consideration it was moved, seconded, and unanimously carried that the ordinance and site development plan be recommended favorably to the Common Council subject to a satisfactory site plan being submitted which incorporates the recommendations of the staff relative to screening and of the Technical Committee of the Transportation Planning Board relative to the location of the driveway entrances. The property sought to be rezoned is located at 309 North Ironwood Drive, South Bend, Indiana 2. The property is owned by Marathon Oil Company, an Ohio Corporation, Findlay,Ohio 3. A legal description of the property is as follows: A part of Lot Numbered 65 as shown on the recorded Plat of Jefferson Heights Addition to the City of South Bend, Indiana, which part is bounded and described as follows: Beginning at a point 154 feet South of the original North East corner of said Lot No-.651 thence West 130.2 feet to the East line of a public alley; thence South on said East line of the public alley, a distance of 48 feet; thence East 130.2 feet to the West line of Ironwood Drive (which is the East line of said Lot No. 65); thence North along the said wsst line of Ironwood Drive, a distance of 48 feet to the place of beginning, and being known as Lot Numbered 189 as shown on the Unrecorded Plat of Jefferson Heights Second Addition to said City of South Bend. 4. It is proposed that the property will be put to the following use and the following building will be constructed% Expanded service station facility to replace existing facility on adjacent lots. Modern 3 stall service station building with necessary appurtenances will be constructed on property to replace antiquated existing station.
