HomeMy WebLinkAboutAmend Several Sections Chapter 36 Relating to Taxicabs and other VehiclesORDINANCE No. 5150 -70 Passed by the Common Council of the City of South Bend, February 9, ,,,70 Clerk Of Common Council Presented by me to the Mayor of the City of South Bend, Approved and signed by February 11, ,,70 ��' t�-. / ? 192C Clerk IDEAL PRESS ORDINANCE NO. 5150 -70 AN ORDINANCE TO AMEND SEVERAL SECTIONS OF ORDINANCE NO. 4838- 66fiENTITLED " AN ORDINANCE REPEALING CHAPTER 36 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, RELATING TO TAXICABS AND OTHER VEHICLES; AND ENACTING AN ORDINANCE REGULATING TAXICABS AND OTHER VEHICLES; LICENSING TAXICABS AND TAXICAB DRIVERS; PROVIDING FOR TAXICAB STANDS ON THE PUBLIC STREETS; PROVIDING PENALTIES FOR THE VIOLATION THEREOF ", AS AMENDED. ORDINANCE NO.4870 -66 and ORDINANCE NO.4901 -66 BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA SECTION I. That Ordinance No. 4838 -66, as amended, be further amended as follows: (1) Section 1. (c) Delete in entirety and substitute the following: "Driver's license means the written permit issued by the City Controller to a person to drive a taxi- cab upon the streets of the City of South Bend, Indiana." ORDINANCE NO 4870 -66 (2) Section 11. Delete in entirety and substitute the following: "An application for a taxicab driver's license shall be filed with the City Controller on forms pro- vided by the City of South Bend; and such application shall be verified under oath and shall contain the following in- formation: (a) The names and addresses of four residents of the City of South Bend who have known the applicant for a period of five years and who will vouch for the sobriety, honesty, and general good character of the applicant. (b) The experience of the applicant in the trans- portation of passengers. (c) The educational background of the applicant. (d) A concise history of his employment. Each application shall be accompanied by a certifi- cate from a reputable physician of the City of South Bend certifying that, in his opinion, the applicant is not suffer- ing with any disease or infirmity which might make him an un- safe or unsatisfactory driver. At the time the application is filed the applicant shall pay to the City Controller the sum of Five Dollars ($5.00). The provisions of this section shall not apply to persons now having a valid taxicab drivers license at the time this ordinance becomes effective, but such persons shall comply with the renewal provisions of this section on and after January 1, 1967." (3) Section 12. Delete in entirety and substitute the following: "Before any application is finally passed upon by the City Controller the applicant shall be required to show that he has a current motor vehicle operator's permit issued by the State of Indiana." (4) Section 13. Delete in entirety and substitute the following: "Traffic and Police Record. The Police De- partment shall conduct an investigation of each applicant for a taxicab driver's license and a report of such in- vestigation and a copy of the traffic and police record of the applicant, if any, shall be attached to the application for the consideration of the City Controller." (5) Section 14. Delete in entirety and substitute the following: "The City Controller shall upon consideration of the application and the reports and certificate required to be attached thereto shall approve or reject the applica- tion. If the application is rejected, the applicant may request a personal appearance before the Board of Public Works and Safety to offer evidence why his application should be reconsidered. The City Controller shall submit in writing to the Board his reasons for rejecting such application." ORDINANCE NO. 4901 -66 (6) Section 15X Delete in entirety and substitute the following: "Upon approval of an application for a taxi- cab driver's license the City Controller shall issue a license to the applicant which shall bear the name, address, color, age,signature and photograph of the applicant. Such a license shall be in effect for the remainder of the calendar year. A license for every calendar year thereafter shall be issued upon the applicant making a showing that he is the holder of a valid Public Passenger Chauffeur's License issued by the State of Indiana and the payment of One Dollar ($1.00), unless the license for the preceding year has been revoked." SECTION II. This Ordinance shall be in full force and effect from and after its adoption by the Common Council of the City of South Bend, Indiana, its approval by the Mayor and legal publication.
