ORDINANCE NO. 5279 -71
AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68 AS AMENDED,
COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,
INDIANA (Chapter -40, Municipal Code), AS AMENDED.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA.
Section 1:
Ordinance No. 4990 -68, as amended, which ordinance is commonly known
as the Zoning Ordinance of the City of South Bend, Indiana, be and the some hereby is
amended in order that the zoning classification of the following described real estate in
the City of South Bend, St. Joseph County, State of Indiana:
Part of the Southeast Quarter (1/4) of the Southeast Quarter
(1/4) of Section 33, Township 38 North, Range 2 East
described as follows:
Beginning at a point 40 feet West and 425 feet South of the
Northeast comer of said Quarter Quarter Section (which point
is on the West line of Bendix Drive); thence South 160 feet;
thence West 565 feet, more or less, to the East line of the
recorded Replot of Lincoln Plaza 2nd Addition; thence North
160 feet to the Southwest comer of the property conveyed to
Robert Blum Lodge 278 Independent Order of Odd Fellows,
by a deed recorded October 22, 1970 in Deed Record 731
page 635, thence East along the South line of said Odd
Fellows property 565 feet to the place of beginning, in
St. Joseph County, Indiana,
be and the some hereby is established as = "C" Commercial District ands "A"
Height and Area District, subject to the site plan attached.
Section 2:
This ordinance shall be in full force and effect from and after its passage by
the Common Council, approved by the Mayor, and legal publication.

The attached rezoning petition of Louis Gruszynski,
et al. was legally advertised on February 6 and 13, 1971
and was given public hearing on February 16, 1971. The
following action was taken by the Area Plan Commission:
After due consideration, a motion was made,
seconded and unanimously passed that this
ordinance be recommended favorably to the
Common Council.
Excerpts from the minutes of the Area Plan Commission
meeting will be forwarded to you at a later date.
