ORDINANCE NO, 5278 -71
An Ordinance Amending and Supplementing Chapter 40
of the Municipal Code of South Bend, Indiana
Be it enacted by the Common Council of the City of South Bend,
Indiana, that:
Section 1. - Chapter 40 of the Municipal Code of South Bend,
Indiana (South Bend City Zoning Ordinance No. 4990) be, and the same is
hereby amended, supplemented and changed in Section 40 -14 and Section
40 -24 thereof to provide that the following described real estate located in
the City of South Bend, Indiana, to -wit:
Lot Numbered Fifty -seven (57) except
One Hundred Twenty -three and Fifty -nine
Hundredths feet (123, 59) off the South side,
in Jefferson Heights Addition to the City of
South Bend;
be and the same hereby is, changed in its Use District Regulation classification
from "A" Residential to "B" Residential with no change in its Height and Area
District classification, subject to and in accordance with the site development
plan as submitted with the petition to amend as filed by Jerry Claeys, Jr. and
Evadna Claeys, husband and wife, and Crowe, Chizek and Company by
Mendel Piser and Joseph Bauters,
Section 2 - This ordinance is to be in full force and effect from
and after its enactment, the approval of the Mayor, and its publication
according to law.
Section 3 - All prior ordinances affecting the above described
tracts of land in conflict herewith are repealed,

The attached rezoning petition of Jerry Claeys, et
al, was legally advertised on February 6 and 13, 1971 and
was given public hearing on February 16, 1971. The
following action was taken by the Area Plan Commission:
After due consideration, a motion was made,
seconded and unanimously passed that this
ordinance and site plan be recommended favor-
ably to the Common Council of the City of
South Bend.
Excerpts from the minutes of the Area Plan Commission
meeting will be forwarded to you at a later date.
