Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots Numbered One (1) and Two (2) as shown on the recorded Plat of T & S Cameron's Minor Subdivision recorded September 23, 1992 as Document Number 9234947 in the Office of the Recorder of St. Joseph County, Indiana. The Area Plan Commission at its public hearing on February 19, 2002, took the following action: Upon a motion by John DeLee, being seconded by Alberta Husband and unanimously carried, the proposed ordinance and site development plan of Thomas Jerome Cameron to zone from "B" Residential, "A" Height and Area to "C" Commercial, "E" Height and Area, property located at 3502 Lincolnway West, City of South Bend, as tabled is sent to the Common Council with a favorable recommendation sub'ect to a final site plan showing a six foot high solid wood fence and to require the petitioner to wor~ with the Staff to provide further buffering such as berming and plantings along the south property line. The petition area abuts commercially zoned property to the east and west and there are other commercially zoned properties to the north across Lincolnway West. It is the Commission's opinion that the proposed commercial zoning and uses are not out of character with the surrounding development and are reasonable along Lwcolnway West in this area. SURROUNDING LAND USE AND ZONING: Located to the north are commercial businesses zoned "C" Commercial, "A" height and area, an office zoned "C" Commercial, "C" height and area and single-family homes zoned "A" Residential, "A" height and area; to the east is an office zoned "C-1" Commercial, "A" height and area; to the south are single-family homes zoned "A" Residential, "A" height and area; and to the west is a kennel zoned "C" Commercial, "A" height and area. ACCESS: Access to the site is from Lincolnway West. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site. DRAINAGE: The drainage has been addressed by the petitioner. SITE DATA: The total site to be rezoned is 1.5 acres. Of that, the buildings will occupy 11,270 square feet, or 17 percent of the site; the parking and drives will occupy 35,532 square feet, or 54 percent of the site; and 19,392 square feet or 29 percent of the site will remain as open space. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, flood hazards, wetlands or environmental hazard areas are present. SITE PLAN: The site plan is preliminary. AGENCY COMMENTS: The City Engineer has commented that: 1. the existing lots will need a replat to create new openings in the non-access easement; 2. the - final site plan will need to develop shoulder construction, curb and walk, or accel/decel lanes; and 3. the drainage plan should use the rational method. PRELIMINARY,-- STAFF RECONII~IENDATION: - Based on information available. prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a _ .. _...
