AN ORDINANCE APPROVING A CONTRACT
BETWEEN THE CIVIL CITY OF SOUTH
BEND AND THE CITY OF SOUTH BEND
DEPARTMENT OF REDEVELOPMENT FOR THE
CONVEYANCE OF TWO PARCELS OF REAL
ESTATE LOCATED IN THE CITY OF SOUTH
BEND AND OWNED BY THE CIVIL CITY OF
SOUTH BEND
WHEREAS, the Civil City of South Bend is the owner of
the two hereinafter described parcels of real estate, the first
of which was formerly used and occupied by the Water Works of
the City of South Bend and the second of which was formerly used
and occupied by the Civil City of South Bend as a city hall and
parking lot, and
WHEREAS, said real estate is no longer needed by the
City of South Bend for its purposes, and
WHEREAS, said parcels of real estate were included in
the Urban Renewal Plan approved by the Common Council of the City
of South Bend on the 9th day of September, 1968, as land donations
to be made by the City of South Bend for non cash credits to the
Department of Redevelopment, and
WHEREAS, the Civil City of South Bend and the City of
South Bend Department of Redevelopment entered into an agreement
dated the 8th day of September, 1970, wherein the Civil City of
South Bend agreed to convey legal title to said parcels of real
estate to the City of South Bend Department of Redevelopment
for the purpose of obtaining non cash credits to the City of
South Bend Department of Redevelopment in the total sum of
$263,712.00 from the Department of Housing and Urban Development,
said sum being the appraised value of said real estate as deter-
mined by three appraisers duly appointed by the Judge of the
Circuit Court of St. Joseph County, Indiana, to appraise said
parcels of real estate, and
WHEREAS, the Civil City of South Bend is empowered to
make a conveyance for the purposes herein set forth to the City
of South Bend Department of Redevelopment pursuant to the pro-
visions of the Acts of the Indiana General Assembly of 1957, ch.
229 SlAsamended, and the Acts of the Indiana General Assembly
of 1905, ch. 129 §53,
NOW, THEREFORE, be it ordained by the Common Council of
the City of South Bend, Indiana:
SECTION I. That an Agreement dated the 8th day of September, 1970,
entered into between the Civil City of South Bend and the City of
South Bend Department of Redevelopment for the conveyance by the
Civil City of South Bend to the City of South Bend Department of
Redevelopment of certain real estate for the purpose of obtaining
non cash credits to the City of South Bend in the total sum of .
$263,712.00 from the Department of Housing and Urban Development
is hereby approved and confirmed; said real estate being located
in the City of South Bend, County of St. Joseph, State of Indiana,
being described as follows:
Parcel 1
A part of Lots 24 and 25 in the recorded Plat
of the South Bend Manufacturing Company's
Addition to the Town, now City of South Bend,
and a part of Lot 102 in the recorded Plat of
the Original Plat of the Town, now City of
South Bend, all in the Northwest 1/4 of
Section 12, Township 37 North, Range 2 East,
described as follows:
Beginning at a point 90 feet East, along the
North line, of the Northwest corner of said
Lot 24; thence South 52 feet; thence South
460 59' East 112.6 feet to a point on the
West line of said Lot 25, said point is 63
feet South, along said West line, of the
Northwest corner of said Lot 25; thence
North 34 feet along the West line of said
Lot 25; thence Northeasterly to the inter-
section of the North line of said Lot 25 and
the Southwesterly line of Artesian Avenue;
thence Northwesterly along the Southwesterly
line of Artesian Avenue to the intersection
with the North line of said Lot 24; thence
West along the North line of said Lot 24 to
the Point of Beginning.
Parcel 2
Lots Numbered Eight (8) and Nine (9) as
shown on the recorded Original Plat of
the Town, now City of South Bend.
SECTION II. The Mayor of the City of South Bend is hereby directed
and authorized in the name of the City of South Bend to execute any
and all necessary instruments to accomplish the conveyance of each
of said parcels of real estate and the City Clerk is directed and
authorized to attest any such instruments and affix the seal of
the City thereto.
SECTION III. This Ordinance shall be in full force and effect
from and after its adoption by the Common Council and approval
by the Mayor.
