BE IT ENACTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, that: Section 1• Ordinance No. 4990 - Chapter 40 of the Municipal Code, (formerly Zoning Ordinance No. 3702) of the City of South Bend, Indiana, be and the same is hereby amended, supplemented and changed to provide that the following described real estate located in the City of South Bend, Indiana, to -wit: Two acres taken off of and from the East side of the South half of Twenty -six (26) acres taken off of and from the West side of the Southwest quarter of the Southwest quarter of Section 32, Township 38 North, Range 3 East, more particularly described as follows: Beginning at a point on the South line of the Southwest quarter of the Southwest quarter of said Section 32, 726 feet East of the Southwest corner thereof; thence North 660 feet; thence East 132 feet; thence South 660 feet; thence West 132 feet to the point of beginning; subject to 40 feet off of the entire South end thereof for right -of -way for Edison Road. be and the same hereby is changed in its Use District Regulation Classification to "C" Commercial District and in its Height and Area District Classification to "A" Height and Area District, in accordance with the site development plan filed herewith. Section 2: This Ordinance is to be in full force and effect from and after its enactment, approval by the Mayor and its publicatiogy *cording to law. INDIANA 98801 (210) M4571 The attached rezoning petition of Hoffman Brothers Auto Electric, Inc. was legally advertised under date of July 11 and July 18, 1970 and given public hearing on July 21, 1970. The following action was taken on July 21, 1970. After due consideration, it was moved, seconded and carried that the ordinance be recommended favorably to the Common Council. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report.
