ORDINANCE NO. 5314 -71
AN ORDINANCE ESTABLISHING A SCHEDULE OF RATES
AND CHARGES FOR SERVICES RENDERED BY THE WASTE-
WATER TREATMENT PLANT OF THE CITY OF SOUTH BEND
TO AREAS OUTSIDE THE CORPORATE LIMITS OF THE
CITY OF SOUTH BEND, AS AMENDED.
WHEREAS, in certain instances, individuals outside the corporate
limits of the City of South Bend desire to be connected to the sani-
tary sewers of the City of South Bend,
WHEREAS, annexation of these area, in some cases, is not
feasible at the present time,
WHEREAS, areas served outside the corporate limits of the City
of South Bend would provide no tax revenue to the City nor would they
provide any contribution to the Cumulative Sewer Fund,
WHEREAS, availability of sanitary sewer service is desirable
and necessary to the development and expansion of such areas and to
properly protect the health, well being, and property of such areas
and their inhabitants, and will benefit the general welfare of the
inhabitants of the City of South Bend,
WHEREAS, the Wastewater Treatment Plant of the City of South
Bend would incur the cost of repair and maintenance of the sanitary
sewers and related accessories and appurtenances serving these areas,
WHEREAS, there are no sewage rates or charges established
for service to said areas outside of the corporate limits of the
City of South Bend, and the Common Council of the City of South Bend,
Indiana, now finds that rates and charges should be established.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend, Indiana:
SECTION I. That there shall be and there is hereby established
for the use of and the service by the Wastewater Treatment Plant of
the City of South Bend rates and charges for the customers outside
corporate limits of South Bend equal to 15.0% of such rates and charges
as are established for the customers within the City of South Bend.
SECTION II. This Ordinance shall be in full force and effect
from and after its adoption and approval by the Mayor.

RE: Sewage Rate Ordinance
PROPS: John L. Hunter, Director of Utilities
is an ordinance requesting that rates for customers outside the
City limits of South Bend, Indiana be increased to 120 per cent above
rates established for customers within the City of South Bend, Indiana.
Th,e average customer pays approximately $40 per year for this service.
It will mean an approximate additional charge of $8 per year for the
average residential. user. For a commercial user it will vary accord-
ing to his present bill.
The actual revenue developed will be minor, but the sewers transporting
wastes are a7]_ constructed by city consumers and this amount will aid
in a small way. It is more of a principle than a revenue incentive to
approve this ordinance. It is just good reasoning that people living
outside the corporate limits of South Bend, and paying lower tax rates,
should pay additional for city services. This is a city service.
