I -- -- 3525 South-Michigan Avenue William Farabaugh, Attorney ORDINANCE NO. 5301-71 AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. 499'0. -68 CHAPTER 40 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, FORMERLY REFERRED TO AS ZONING ORDINANCE NO. 3702 AS AMENDED BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section 1. That Zoning Ordinance No. 49990 -68 Chapter 40 of the Municipal Code of the City of South Bend, Indiana, formerly known as Zoning Ordinance No. 3702, be and the same is hereby amended and supplemented by changing the zoning classification of the following described property from "B" Residence District to "C" Commercial District, subject to site plan attached hereto: Lots numbered 4, 5 and 6 of John E. Walz's revised addition to the City of South Bend, St. Joseph County, Indiana. Section 2. This Ordinance shall be in full force and effect from and after its enactment, approval by the Mayor and legal publica- tion. A member of the Common Council of the City of South Bend, Indiana. The property sought to be rezoned is located at 3525 South Michigan Avenue South Bend, Indiana 2. The property is owned by present owner is Mabel F. Hine, 3525 South Michigan Street and is being sold to Seeley's Boot Shop, Inc., presently of 218 St. Joseph Street. 3. A legal description of the property is as follows Lots numbered 4, 5 and 6'of John E. Walz's revised addition to the City of South Bend, St. Joseph County,Indiana (CONTINUE ON THE REVERSE SIDE IF NECESSARY) 8/3/70. 4 It is desired and requested that the foregoing property be rezoned From B Use and A Height and Area. District To C Use and n Height and Area District. 5. It is proposed that the property will be put to the following use and the following building (s). will be constructed (include number of dwelling units if residential) Seeley's Boot'. Shop, Inc., intends purchasing the property and erecting a retail store for the selling of children's shoes and allied special furnishings; occupying the entire building, but possibly subleasing a portion thereof to a retail business, the entire building.being approximately 60 feet by 110 feet being located approximately 5 feet from the South line of the lot, but with consideration being given to a lesser side yard in view of retaining wall construction and difference of elevation between the adjacent side lot and the instant property. Hine and Seeley's Boot Shop, Inc, was readvertised for a second public hearing on May 8 and 15, 1971 and a public hearing was held on Tuesday, May 18, 1971, at which time the following action was taken: After due consideration, it was moved, seconded and carried that the ordinance and site develop- ment plan be recommended favorably to the Common Council of the City of South Bend.
