ORDINANCE NO. 5290 -71
AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF
SOUTH BEND, INDIANA - 1962 SECTION 40 AS AMENDED AND GENERAL
ORDINANCE NO. 4990 -68, AND THE ACCOMPANYING MAP THERETO,
GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE BY
CHANGING THE CLASSIFICATION OF THE USE DISTRICT FOR A
CERTAIN PARCEL OF LAND, AS AMENDED
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA:
Section 1:
The municipal Code of the City of South Bend, Indiana, 1962, and General
Ordinance No. 4990 -68 and the accompanying map thereto, as amended, and
further amended insofar as the same relates to that certain parcel of
land situate in the City of South Bend and more particularly described
as follows:
See attached legal description of Parcel 10 -1 and 10 -1A attached
hereto and made a part hereof.
The zoning classification of said real estate is hereby rezoned from "D"
Light Industrial and "E" Heavy Industrial Use and "F'.' Height and Area to
"C" Commercial Use and "A" Height and Area and in conformance with the
approved site plan on file in the Office of the Area Plan Commission, for
use only as follows:
United States Post Office Buildings
Section 2:
This ordinance shall be in full force and effect from and after its
passage by the Common Council, approved by the Mayor and legal publication.

follows: Beginning at the intersection of the east boundary of South
Michigan Street (U.S.R. 31) and the north boundary of East Monroe
Street; thence North 0 degrees 29 minutes 07 seconds West 42.33 feet
along said east boundary; thence Northeasterly 381.53 feet along an
arc to the right and having a radius of 624.57 feet and subtended by
a long chord having a bearing of North 17 degrees 00 minutes 53 sec-
onds East and a length of 375.62 feet; thence North 34 degrees 30 min-
utes 53 seconds East 9.42 feet to the south boundary of East Western
Avenue; thence North 89 degrees 37 minutes 15 seconds East 309.62 feet
along said south boundary; thence Northeasterly 253.74 feet along an
arc to the left and having a radius of 424.47 feet and subtended by
a long chord having a bearing of North 72 degrees 29 minutes 46 sec-
onds East and a length of 249.47 feet; thence North 56 degrees 45 min-
utes 30 seconds East 119.43 feet; thence South 56 degrees 36 minutes
16 seconds East 123.03 feet; thence Southeasterly 335.73 feet along an
arc to the right and having a radius of 341.97 feet and subtended by a

In response to the request of the Common Council and in confirmation
of Mr. Barbe's statement to the Council, this is to certify that the
Department of Redevelopment will upon the receipt of the field survey
for the area designated for the United States Post Office will provide
the City Clerk with sufficient copies of said survey for attachment to
the Zoning Ordinance passed by the Common Council at its meeting of
April 27, 1971.
We will further notify by memorandum each Council member when this
has been done.
