ORDINANCE NO, 5222 -70
AN ORDINANCE AMENDING AND SUPPLEMENTING
ORDINANCE 4990 - CHAPTER 40 OF MUNICIPAL
CODE (FORMERLY ZONING ORDINANCE 3702) AS
AMENDED,
Be it enacted by the Common Council of the City of South Bend,
Indiana, that:
SECTION 1. - Ordinance 4990 - Chapter 40 of the Municipal
Code (formerly Zoning Ordinance 3702) of the City of South Bend, Indiana
be and the same is hereby amended, supplemented, and changed to pro-
vide that the following described real estate located in the City of South
Bend, Indiana, to -wit:
A tract of land located in the Northwest 1/4 of Section 6,
Township 37 North, Range 3 East and also in the North-
east 1/4 of Section 6, Township 37 North, Range 3 East,
City of South Bend, Indiana, more particularly described
as follows:
Beginning at the intersection of the centerline of Ivy Road
with the Northerly line of Indiana Highway #23; thence
South 53 degrees 16 minutes 30 seconds West along said
Northerly line of Indiana Highway #23, 238. 53 feet, more
or less to the West line of said Northeast 1/4 of Section
6; thence continuing Southwesterly along said Northerly
line of Indiana Highway #23, 68. 45 feet thence North 36
degrees 43 minutes 30 seconds West 115. 25 feet to the
point of curvature of a curve with a deflection angle of
36 degrees 43 minutes 30 seconds to the right and a radius
of 411. 90 feet; thence Northwesterly along said curve an
arc distance of 60. 21 feet to the City of South Bend City
Limits; thence North 53 degrees 16 minutes 30 seconds
East along said City Limits line, 194. 81 feet to the West
line of said Northeast 1/4 of Section 6; thence continuing
Northeasterly along said City Limits line 238 feet, more
or less to the centerline of Ivy Road; thence Southerly
along said centerline of Ivy Road, 217 feet more or less
to the place of beginning, containing 1. 4939 acres more,
be and the same is hereby zoned to "C" Commercial and "G" Height and
Area District, in its Use District Regulation classification subject to the
site development plan attached to and hereby made a part of this ordinance.
SECTION 2. - This Ordinance is to be in full force and effect
from and after its enactment, the approval of the Mayor, and its
publication according to law.

The Ordinance amending and supplementing Ordinance 4990 -68
-- Chapter 40 of the Municipal Code (Formerly Zoning Or-
dinance 3702) as amended was referred back to the Area Plan
Commission by the Common Council for approval of the cor-
rected legal description due to the realignment of the
property.
The following action was taken on August 18, 1970:
After due consideration, it was moved by Mr.
Taylor, seconded by Jerry Miller, that the
Area Plan Commission approve.the ordinance
as amended and it is recommended favorably
to the Commnn Council as amended.
The deliberations of the Area Plan Commission and points
considered in arriving at the above decision are shown in
the excerpts of the minutes attached hereto and made a
part of this report.
