AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE
CITY OF SOUTH BEND, IDENTIFIED AS ORDINANCE NO. 499o,
ORDINANCE NO. 37023 AS AMENDED, TO THE EXTENT IT IS
STILL EFFECTIVE, AND THE MUNICIPAL CODE OF SOUTH BEND,
INDIANA, SECTIONS 40 -1 TO SECTIONS 40 -43, AS AMENDED, TO
THE EXTENT IT IS STILL EFFECTIVE
BE IT ORDAINED by the Common Council of the City of South
Bend, Indiana:
SECTION I. That the following described real estate in
the City of South Bend, Indiana, to -wit:
A part of Area 1 as shown on the recorded replat
of Belleville Unit "D ", an addition to the City
of South Bend, Indiana more particularly described
as follows:
Beginning at a point on the South line of said
Area 1, 125 feet East of the Southwest corner of
said Area 1; thence East along said South line of
Area 1, 75 feet; thence North parallel with the
West line of said Area 1, 163.48 feet; thence
West parallel with said South line of Area 1, 75
feet; thence South parallel with said West line
of Area 1, 163.48 feet to the place of beginning.
be and the same is hereby zoned "C" Commercial Use and "D" Height and
Area District, the same to conform with the site development plan
submitted herein.
SECTION II. This Ordinance shall be in full force and
effect from and after its passage by the Common Council of the City
of South Bend, Indiana, approval by the Mayor of the City of South
Bend, Indiana, and legal publication.

The attached rezoning petition of Colpaert Realty Corporation
was legally advertised under date of July 11 and July 18,
1970, and given public hearing on July 21, 1970.
After due consideration, it was moved, seconded
and carried that the ordinance be recommended
favorably to the Common Council.
The deliberations of the Area Plan Commission and points
considered in arriving at the above decision are shown in
the excerpts of the minutes attached hereto and made a part
of this report.

1. The property souEht to be rezoned is located at the North -
side of Sample Street immediately East of and contiguous to
the Cities Service Oil Company service station located on the
Northeast corner of the intersection of Mayflower Road and
Sample Street (5323 West Sample Street), South Bend, Indiana.
2. The property is owned by Colpaert Realty Corporation. Cities
Service Oil Company has an option to purchase the property
subject to rezoning.
3. A legal description of the property is as follolls:
