ORDINANCE NO. 5252 -70
AN ORDINANCE APPROPRIATING THE SUM OF $315,000.00
FROM THE CUMULATIVE SEWER BUILDING AND SINKING
FUND.
WHEREAS, engineering studies have been completed
outlining needs for a sewer to serve the area south of Ireland
Road in the Phillips Ditch area, and
WHEREAS, funds are now needed for appraisals, land
acquisition, design engineering and construction, and
WHEREAS, a Cumulative Sewer Building and Sinking Fund
has been established,
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND, INDIANA:
SECTION I. That the sum of $315,000.00 be appropri-
ated from the Cumulative Sewer Building and Sinking Fund for
the extension of the southwest trunk sewer.
SECTION II. This ordinance shall be in full force
and effect from and after its passage by the Common Council,
its approval by the Mayor and the fulfillment of all statutory
requirements.

EXCERPTS FROM THE MINUTES OF THE MEETINGS ON ORDINANCE NO. 5252 -70
Ordinance, First _& Second Reading, November 9, 1970
The Ordinance was given first reading by title and second reading in full.
Councilman Grounds made a motion, seconded by Councilman Wise, that the
ordinance be given a public hearing on November 23, 1970. Motion carried.

Committee of the Whole meeting November 23 1970
This being the time heretofore set for public hearing on the above ordinance,
proponents and opponents were given an opportunity to be heard thereon. Mr.
David Wells, Sanitary Engineer, Engineering Department, explained that this
appropriation was for the construction of a 30 -inch sanitary sewer to serve
Gilmer Park and the Forrest G. Hay School on Johnson Road. He said the sewer
is justified and is recommended from an engineering and social point of view.
Mr. Andrew Toth, South Bend architect, stated that his plan for solving storm
drainage problems would be much more economical. City Engineer Lloyd Taylor
stated that three professional engineering firms hired to develop new ideas
for handling storm water did consider Mr. Toth's plan but discarded the idea
because of the great expense involved. Mr. Wells said the School Corporation
has contributed $40,000.00 as their share in the construction of this sewer.
Councilman Grounds objected to the money being spent outside the City, claim-
ing his district is in need of sewers also. He said the Taxpayers of South
Bend are putting up the money for county installation of sewers. Councilman
Fredrick Craven said he agrees with Councilman Grounds, especially in view
of the remonstrance Gilmer Park residents put up to annexation of their
area. Councilman Zielinski made a motion, seconded by Councilman Szymkowiak,
that the ordinance go to the Council as favorable. Motion carried. 9 ayes,
0 nays, 0 absent.
Report of the Committee of the Whole Nov. 23 1970
Council President Laven entertained a motion to waive the reading of the
Committee of the Whole Reports. Councilman Allen so moved. Councilman
Zielinski seconded the motion. Motion carried unanimously.

ORDINANCE NO. 5252 -70
AN ORDINANCE APPROPRIATING THE SUM OF $315,000.00

FUND.
The Ordinance was given third reading. Councilman Reinke made a motion,
seconded by Councilman Zielinski, for passage of the Ordinance. Motion carried..
9 ayes (Councilmen Laven, Allen, Craven, Reinke, Szymkowiak, Wise, Palmer and
Zielinski) 1 nay (Councilman Grounds) 0 absent. Councilman Grounds stated
that he objected to the use of this fund for county sewers and he said his
district needs sewers also and he 'believed the money should be used within the
ci_ty.limits for sewers. Councilman Craven objected to the installation of
sewer in the Gilmer Park area in view of the remonstrance made by the area
residents at the public hearing of the annexation of Gilmer Park. Councilman
Laven said that this demonstrates the ability of the City to cooperate with
other units and other annexed areas in installing sewers.
