ORDINANCE NO. 5250 -70
AN ORDINANCE TO APPROPRIATE $5768.45 FROM THE
MOTOR VEHICLE HIGHWAY FUND TO ACCOUNT MVH -42,
"STREET AND ALLEY MATERIALS ".
WHEREAS, funds have been expended from a regularly
appropriated MVH account for the completion of projects
which have qualified under the Local Road and Street
Program, thereby depleting this account; and
WHEREAS, an emergency exists requiring the appropria-
tion of more money than was appropriated in the annual
budget to cover the cost of certain street construction
projects, and
WHEREAS, a surplus exists in the Motor Vehicle
Highway Fund in excess of $5768.45,
NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND, INDIANA:
SECTION I. That to provide additional funds for the
purchasing of street and alley m��e ials, there is hereby
appropriated from the Motor VehiNO Fund to the following:
Account MVH -42, "Street and Alley Materials"
the sum of $5768.45.
SECTION II. This ordinance shall be in full force
and effect from and after its passage and approval as
required by law.

EXCERPTS FROM THE MINUTES OF THE MEETINGS ON ORDINANCE 5250 -70
Ordinances, First & Second Reading, Nov. 9, 1970
The Ordinance was given first reading by title and second reading in full.
Councilman Zielinski made a motion, seconded by Councilman Palmer, that the
ordinance be given a public hearing on November 23, 1970. Motion carried.

Committee of the Whole Meeting November 23 1970
This being the time heretofore set for public hearing on the above ordinance,
proponents and opponents were given an opportunity to be heard thereon. City
Engineer Lloyd Taylor explained that this ordinance was a companion ordinance
to the following ordinance on the agenda, item #8. He gave an explanation
of the manner in which the local road and street funds must be sought and
appropriated. He said this amount is to cover the cost of street construction
projects which have qualified under the Local Road and Street Program and this
ordinance permits the city to put MVH money received from the state into the
various project accounts. Miss Virginia Guthrie, Executive Secretary of the
South Bend Civic Planning Association said his explanation was confusing and
unsatisfactory and contended that there was a duplication in the bills involv-
ing the street funds. City Controller James Bickel said the legislature sets
out the procedures to follow. Councilman Laven made a motion, seconded by
Councilman Reinke, that the ordinance go to the Council as favorable. Motion
carried. 9 ayes, 0 nays, 0 absent.
Report of the Committee of the Whole November 23 1970
Council President Laven entertained a motion to waive the reading of the
Committee of the Whole Reports. Councilman Allen so moved. Councilman
Zielinski seconded the motion. Motion carried unanimously.

ORDINANCE NO. 5250 -70
AN ORDINANCE TO APPROPRIATE $5,768.45 FROM THE
MOTOR VEHICLE HIGHWAY FUND TO ACCOUNT MVH -42,
"STREET AND ALLEY MATERIALS."
Councilman Craven made a motion to consider this ordinance #21 on the agenda,
after item #22. Councilman Grounds seconded the motion. Motion carried
unanimously. The Ordinance was given third reading. Councilman Craven made
a motion, seconded by Councilman Palmer, for passage of the ordinance, Motion
carried. 9 ayes (Councilmen Laven, Allen, Craven, Reinke, Grounds, Szymkowiak,
Wise, Palmer and Zielinski) 0 nays, 0 absent.
