An Ordinance affecting approximately 119.66 acres lying between York Road and Ironwood Road south of Jackson Road, commonly known as 4 -H Fairgrounds. ORDINANCE NO. 5249 -70 Be it enacted by the Common Council of the City of South Bend, Indiana, that: Section 1 - Ordinance 4990 - Chapter 40 of Municinal Code (formerly Zoning Ordinance 3702) of the City of South Bend, Indiana, be and the same is hereby amended, supplemented, and changed, to provide that the following described real estate located in the City of South Bend, Indiana, to -wit: Beginning at a point thirty -five (35) feet East of the Northwest corner of the Northeast one quarter (NE 1/4) of Section Thirty -one (31), Township Thirty -seven North (T37N), Range Three East (R3E); thence South two hundred fifty (250) feet along the East right -of -way line of York Road, the present City Limits; thence East one hundred eighty (180) feet along the present City Limits; thence South one hundred fifty (150) feet along the present City Limits; thence East three hundred eight (308) feet along the present City Limits to the Northwest corner of the 4 -H Fairground property; thence South eight hundred thirty - seven and fifty hundredths (837.50) feet along the present City Limits line which line is also the West property line of the 4 -H Fairgrounds; thence East seven hundred ninety - four and thirty hundredths (794.30) feet along the present City Limits; thence South one thousand four hundred eighteen and forty -seven hundredths (1418.47) feet more or less along the present City Limits to the South line of the Northeast one quarter (NE 1/4) of Section Thirty -one (31) Township Thirty -seven North (T371N), Range Three East (R3E�; thence East along the South line of the Northeast one quarter (NE 1/4) of said Section Thirty -one (31) to the East line of said Section Thirty -one (31); thence North along the East line of Section Thirty -one (31), Township Thirty -seven North (T37N), Range Three East (R3E), which line is also the centerline of Ironwood Road, to the North line of said Section Thirty -one (31); thence West along the North line of said Section Thirty -one (31) to the point of beginning, containing one hundred seven and twenty -three hundredths (107.23) acres, all in Section Thirty -one, Town- ship Thirty -seven North (T37N), Range Three East (R3E), Centre Township, St. Joseph County, Indiana ALSO: The West two hundred (200) feet taken off of and from the entire West side of the Northwest one cuarter (NW 1/4) of Section Thirty -two (32) Township Thirty -seven North (T37N), Range Three East (R3E), containing twelve and twenty -seven hundredths (12.27) acres, all in Penn Township, St. Joseph County, Indiana ALSO: A tract of land beginning at the intersection of the centerlines of Jackson Road and Ironwood Road; thence East along the centerline of Jackson Road a distance of two hundred (200) feet; thence North thirty (30) feet; thence West two hundred thirty (230) feet to the present City Limits; thence South thirty (30) feet along the present City Limits; thence East thirty (30) feet to the place of beginning, taking in the remainder of the inter- section of Jackson and Ironwood Roads and two hundred (200) feet of Jackson Road to the East, containing sixteen hundredths (,16) acres, all in Section Thirty (30), Town- ship Thirty -seven North (T37N), Range Three East (R3E), Centre Township, Section Twenty -nine (29), Township Thirty - seven North (T37N), Range Three East (R3E), Penn Township, Section Thirty -two (32), Township Thirty -seven North (T37N), Range Three East (R3E), Penn Township, St. Joseph County, Indiana. be and the same hereby is zoned to "A" Residential in its Use District Regulation classification and "A" Height & Area in its Height and Area District classification. BOUWR BEN➢, INDIANA 4W1 (919) T 4571 November 5, 1970 The attached zoning ordinance originated by the Area Plan Commission to rezone recently annexed land was legally advertised on October 10 and 17, 1970, and was given public hearing on October 20, 1970. The following action was taken at that hearing by the Area Plan Commission: After due consideration, Dwight Miller made a motion, seconded by Mr. Bowers, that this petition for zoning be recommended favorably to the Common Council of the City of South Bend. Motion carried unanimously. Excerpts from the minutes are attached and made a part of this report and twenty -five copies of the proposed ordinance are attached. HB:eb Attachs. EXCERPTS FROM THE MINUTES OF THE MEETING OF THE AREA PLAN COMMISSION HELD ON OCTOBER 209 1970 6. An ordinance originated by the Area Plan Commission to zone recently annexed land "A" Residential Use and "A" Height and Area District which is commonly known as the 4 -H Fairground area being approximately 119.66 acres lying between York Road and Ironwood Road south of Jackson Road, located in the City of South Bedd. Mr, Johnson advised the Commission that there is no appeal before the courts on this annexation. The staff recommends this area be placed in the "A" Residential zoned district. The 4 -H Fairgrounds and the TV tower would be non - conforming use and expansion of these uses would be possible through the issuance of a Special Use permit granted by the Board of Zoning Appeals. Mr. Johnson also stated that it is his understanding that a TV tower has no classification and Mr. Taylor said that fairgrounds are not listed either. He asked if it made any difference if it is zoned heavy industrial. Mr. Bellinger apprised the Commission that the proposed zoning was checked with the South Bend Building Commissioner, Forrest West, and he stated he could see no problem in expanding the 4 -H Fairground building facilities under the "A ".zoning classification. Mr. Johnson said the staff was convinced there would be no hardship on either the TV Tower(s) or the fairgrounds. Mr. Taylor apprised Mr. Bowers, after his inquiry, that it does not make any difference how it is zoned; it will still be a non - conforming use. After due consideration, Dwight Miller made a motion, seconded by Mr. Bowers, that this petition for rezoning be recommended favorably to the Common Council of the City of South Bend.
