ORDINANCE NO. 5247 -70
AN ORDINANCE AMENDING THE MUNICIPAL CODE
OF THE CITY OF SOUTH BEND, INDIANA -1962
SECTION 40 AS AMENDED AND GENERAL ORDIN-
ANCE NO. 4990 -68, AND THE ACCOMPANYING
MAP THERETO, GENERALLY KNOWN AS THE SOUTH
BEND ZONING ORDINANCE BY CHANGING THE
CLASSIFICATION OF THE USE DISTRICT FOR A
CERTAIN PARCEL OF LAND, AS AMENDED.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND INDIANA:
Section 1•
The municipal Code of the City of South Bend, Indiana,
1962, and General Ordinance No. 4990 -68 and the accompany-
ing map thereto, as amended, are further amended insofar
as the same relates to that certain parcel of land situate
in the City of South Bend, and known and designated as:
Part of the Southwest Quarter of the Southeast
Quarter of Section 31, Township 38 North, Range
3 East, more particularly described as follows:
Beginning at a point on the Westerly line of
Indiana State Road No. 23 (Edwardsburg Highway)
801.38 feet Southwesterly of the North Line of
the said Southwest Quarter of the Southeast Quar-
ter of Section 31; thence continuing South 34
degrees 32 feet 40 inches West along said Westerly
line of said Highway a distance of 177.35 feet to
a point; thence North 55 degrees 27 feet 20 inches
West, a distance of 130.00 feet to a point; thence
North 34 degrees 32 feet 40 inches East a distance
of 177.35 feet to a point; thence South 55 degrees
27 feet 20 inches East, a distance of 130.00 feet
to the point of beginning. Containing 0.528 acres,
in St. Joseph County, Indiana,
by changing the classification of the "Use District" from
no zone to C -I Commercial and "B" Height and Area District
and in conformance with the approved site plan on file in
the Office of the Area Plan Commission, for use only as follows:
(1) Professional Office Building, (2) Barber Shop; (3) Beauty
Shop; (4) Florist; (5) Drug Store; (6) Meat Market; (7) Office
Building.
Section 2:
This ordinance shall be in full force and effect from and
after its passage by the Common Council, approved by the Mayor
and legal publication.

This is to advise you that the amendments to
the above ordinances were considered and approved at
the regular meeting of the Area Plan Commission held
on Tuesday, January 19, 1971. The following action
was taken:
Motion was made by Mr. Lehman and seconded
by Mr. Rothermel to approve the amendments
and so inform the Council. Motion carried.
An excerpt from the minutes is attached and made
a part of this report.
