ORDINANCE NO. 5399 -72
AN ORDINANCE AMENDING SECTIONS 20 -18 AND 20 -55,
CHAPTER 20, VEHICLES AND TRAFFIC, IN THE MUNICIPAL
CODE OF THE CITY OF SOUTH BEND, INDIANA, 1971.
The City of South Bend, Indiana, is authorized in Sections
20 -18 and 20 -55, Chapter 20, Vehicles and Traffic, in the Municipal
Code of the City of South Bend, Indiana, 1971, to charge a fee for
violation of overtime parking regulations ( §20 -18), and to collect
parking meter charges for the use of space in a parking meter zone
( §20 -55)•
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend, Indiana:
SECTION I. Section 20 -18, Chapter 20, Vehicles and Traffic,
in the Municipal Code of the City of South Bend, Indiana, 1971, is
hereby amended to read as follows:
The owner or operator who has been notified of a violation
of the parking regulations, as herein provided, may, within forty -
eight (48) hours after being notified, answer at the office of the
Traffic Violations Bureau, to the charge of such violation as set
forth in such notice, and pay a prescribed fee of Two Dollars ($2.00)
in settlement of the offense or charge, or Five Dollars ($5.00) after
the expiration of the forty -eight hours. An acceptance of and payment
of the fee and the authority by the clerk shall be deemed complete
satisfaction for the violation and the violator shall be given a
receipt which so states.
SECTION II. Section 20 -55 Chapter 20, Vehicles and Traffic,
in the Municipal Code of the City of South Bend, Indiana, 1971, is
hereby amended to read as follows:
(a) Parking or standing a vehicle in a designated space in
a parking meter zone shall be lawful for twelve (12) minutes upon
deposit of a One Cent ($.01) coin, thirty (30) minutes upon the
deposit of a Ten Cent ($.10) coin, sixty (60) minutes upon the deposit
of two (2) Ten Cent ($.10) coins. All meters over one (1) hour shall
be two (2) Ten Cent ($.10)coins per hour. No person shall remain in
such parking space beyond the parking time limit set for such parking
space.
(b) The parking meters shall be operated in the parking
meter zone between the hours of 8:00 A.M. and 6:00 P.M. on any
Tuesday, Wednesday, Thursday, Friday and Saturday and between the
hours of 8:00 A.M. and 9:00 P.M. on any Monday, except holidays.
(c) Within the meaning of this Article, the term "holiday"
shall include the following days only: January 1, Memorial Day, the
Fourth of July, the First Monday in September, December 25, and the
day designated and set aside by the President of the United States
as a day of Thanksgiving.
SECTION III. This ordinance shall be in full force and
effect from and after its passage by the Common Council, its approval

CHAPTER 20, VEHICLES AND TRAFFIC, IN THE
MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1971.
Respectfully report that they have examined the matter and that in their opinion SHOULD GO TO THE COUNCIL
AS FAVORABLE AS AMENDED.
Councilman Nemeth made a motion to amend Section 1,
Paragraph two, to read as follows:
The owner or operator who has been notified of a violation
of the parking regulations, as herein provided, may,
within five days after being notified, answer at the office
of the Traffic Violations Bureau, to the charge of such
violation as set forth in such notice, and pay a prescribed
fee of $Two Dollars ($2.00) in settlement of the offense or
charge, or Five Dollars ($5.00) after the expiration of
the five days. An acceptance of and payment of the fee and
the authority by the clerk shall be deemed complete satis-
faction for the violation and the violator shall be given
a receipt which so states.
Councilman Kopczynski seconded the motion and it was carried.
