GAMMON tg 72 Clerk ORDINANCE NO. 5388 -72 AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Chapter 40, Municipal Code). BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section 1: Ordinance 4990 -68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classificati of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: A part of the Southeast 1/4 of Section 24, Township 37 North, Range 2 East and a part of the Northeast 1/4 of Section 25, Township 37 North, Range 2 East in the City of South Bend, Indiana, more particularly described as follows: Beginning at a point on the West line of Miami Hills Addition, 1269.25 feet on an assumed bearing of South 10 39' East of the Northeast corner of South - more Heights as shown on the Southmore Heights Street Layout Dedication Plan as recorded in Plat Book 15, Page "S" in the Office of the Recorder of St. Joseph County, Indiana, said point also being on the West line of the plat of Miami Hills Addition, a plat recorded in Plat Book 17, Page "M" in said Recorder's Office of St. Joseph County, Indiana; thence continuing South 10 39' East along said West line of Miami Hills Addition, 622.62' feet to the Northerly line of Chippewa Avenue; thence South 550 12' 50" West along said Northerly line of Chippewa Avenue, 495.02 feet; thence continuing along said Northerly line of Chippewa Avenue South 860 50' West, 270.05 feet; thence North 40° 54' 50" East, 79.08 feet; thence North 300 12' 24" East, 143.50 feet; thence North 30 57' 24" East, 396.00 feet; thence North 151 32' 36" West, 327.00 feet; thence North 340 27' 24" East, 267.90 feet; thence South 550 32' 36" East, 302.05 feet; thence North 880 21' East, 80 feet; thence South 10 39' East, 30 feet; thence North 880 21' East, 113.50 feet to the place of beginning and containing 11.2609 acres more or less, and also A part of the Southeast 1/4 of Section 24, Township 37 North, Range 2 East and a part of the Northeast 1/4 of Section 25, Township 37 North, Range 2 East in the City of South Bend, Indiana, more particularly described as follows: Beginning at the Southeast corner of said Southmore Heights as shown on the recorded Southmore Heights Street Layout Dedication Plan, said point also being on the West line of above mentioned Miami Hills Addition; thence North 10 39' West along said West line of Miami Hills Addition, 204.09 feet to the Southerly line of Chippewa Avenue; thence South 550 12' 50" West along said Southerly line of Chippewa Avenue, 389.15 feet to the Northerly line of the Erskine Municipal Golf Course, thence North 86° 50' East along said Northerly line of the Erskine Municipal Golf Course, 325.97 feet to the place of beginning and containing 0.7634 acres more or less. be and the same hereby is established as a "B" Residence District and a "B" Height and Area District. However, due to a proposed change in the site plan affecting the second phase of development it requires a rehearing on this matter and subsequent action by the Common Council. The property sought to be rezoned is located at an inland site bounded on the crest by the apartment buildings belonging to Southmore Mutual Housing Corporation, on the east by the west line of Miami Hills Addition to the City of South Bend, Indiana, on the south by Erskine Park Golf Course and on the north by an irregular line approximately 625 feet north of the northerly line of Chippewa Avenue, containing 12.0243 acres, more or less. 2. It is proposed that the property will be put to the following use and the following building (s) will be constructed (include number of dwelling units if residential) 150 apartment units (an increase of one over the existing site plan), with a total number of bedrooms of 306 (a decrease of 40 from the existing site plan). This petition seeks to make changes to a final site development plan made a part of Ordinance No. 5129 -69 of the Common Council of the City of South Bend, Indiana, dated December 8, 1969, in which the subject real estate and other real estate was rezoned as "B" Residence District and "B" Height and Area District. These changes consist of moving the location of buildings, parking area and recreational area, with an increase of one dwelling unit and a decrease of 40 bedrooms, all which changes were suggested by the Federal Housing Administration. 6.
