ORDINANCE NO. 5368 -71
AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY
OF SOUTH BEND, INDIANA - 1962 SECTION 40 AS AMENDED
AND GENERAL ORDINANCE NO. 4990 -68, AND THE ACCOMPANYING
MAP THERETO, GENERALLY KNOWN AS THE SOUTH BEND ZONING
ORDINANCE BY CHANGING THE CLASSIFICATION OF THE USE
DISTRICT FOR A CERTAIN PARCEL OF LAND
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, AS FOLLOWS:
SECTION 1
The municipal Code of the City of South Bend, Indiana, 1962, and
General Ordinance No. 4990 -68 and the accompanying map or maps
thereto, as amended, are further amended insofar as the same relates
to that certain parcel of land situate in the City of South Bend,
and known and designated as:
Beginning at the point of intersection of the Northerly
right -of -way line of Prairie Avenue and the West right -
of -way line of Olive Street; thence Southwesterly along
the Northerly right -of -way line of Prairie Avenue to a
point of intersection of the Northerly right -of -way line
of Prairie Avenue and the East right -of -way line of Kaley
Street (which presently is a 30 foot wide 1/2 right -of -way);
thence North along said East right -of -way line of Kaley
Street to a point of intersection with the South line of
Ewing Avenue; thence East along said South right -of -way
to a point of intersection with the West right -of -way
line of Olive Street; thence South along the West right -
of -way line of said Olive Street to the place of beginning,
all in the northwest 1/4 of Sec. 22, T37N, R.2E, Portage
Township, St. Joseph County, Indiana.
Subject to all legal highway and streets.
by changing the classification of the "Use District" from "B"
Residential and "Unzoned" to "A" Residential and from "No" Height
and Area District to "A" Height and Area District.
SECTION 2
This ordinance shall be in full force and ��£ect from and after its
passage by the Common Council, approval /the may and legal publication.

Re: Rezoning ordinance originated by the
Area Plan Commission to zone property
recently annexed and located south of
Ewing Ave., west of Olive Street, east
of Kaley St. and north of Prairie Ave.
The attached ordinance originated by the Area Plan
Commission of St. Joseph County was advertised for public
hearing on September 11 and September 18, 1971 and a public
hearing was had on September 21, 1971 at which time a motion
was made, seconded and carried that this public hearing be
continued to the next regular meeting.
At the public hearing held on Tuesday, October 19,
1971, the following action was taken:
After due consideration, a motion was made,
seconded and unanimously carried that this
proposed rezoning be recommended favorably
to the City Council.
Excerpts from the minutes of both meetings are
attached hereto.
