AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR SPECIFIED
PROPERTIES LOCATED ALONG THE LINCOLNWAY WEST COMMERCIAL
CORRIDOR BETWEEN LASALLE STREET AND BENDIX DRIVE, IN THE CITY OF

BE IT ORDAINED by the Common Council of the City of South Bend, Indiana:
SECTION I. The Zoning maps entitled "Book of Maps" Section 21-5 Chapter 21-
Zoning, Municipal code of the City of South Bend, are hereby amended by the attached map-

RE: A proposed ordinance initiated by the Common Council of the City of South Bend to
rezone the portion of the City of South Bend along the Lincolnway West Commercial
Corridor between LaSalle Avenue and Bendix Drive, City of South Bend, as tabled - APC
#2140-02
Dear Council Members:
The above referenced ordinance initiated by, the Common Council was legally advertised
on October 3, 2002. The Area Plan Commission at its public hearing on October 15,
2002, took the following action:
Upon a motion by Charlotte Sobel, being seconded by Tim Walz and unanimously carried,
the proposed ordmance initiated by the Common Council of the City of South Bend to
rezone the portion of the City of South Bend along the Lincolnway West Commercial
Corridor between LaSalle Avenue and Bendix Dr><ve, City of South Bend, as tabled is sent
to the Common Council with a favorable recommendation. While the Commission
recognizes that further work will need to be done along this corridor in order to achieve
overall zoning appropriateness, this rezoning represents a positive first step in that
direction. By bringing zoning districts into conformance with the dominant use of certain
areas along the corridor, this rezoning should have a positive effect on the corridor and
surrounding neighborhoods.
PLEASE NOTE that the Ordinance has been amended by the petitioner and is different
than that used for the Common Council's first reading. The amended Ordinance was the
Ordinance legally advertised and heard by the Area Plan Commission.
The deliberations of the Area Plan Commission and points considered in arriving at the
above decision aze shown in the minutes of the public hearing, and will be forwarded to
you at a later date to be made a part of this report.

PRELIMINARY
STAFF RECOMMENDATION: Based on information available prior to the
public hearing, the Staff recommends that this
petition be sent to the Common Council with a
favorable recommendation. While the Staff
recognizes that further work will need to be
done along this corridor in order to achieve
overall zoning appropriateness, this rezoning
represents a positive first step in that
direction. By bringing zoning districts into
conformance with the dominant use of certain
areas along the corridor, this rezoning should
have a positive effect on the corridor and
surrounding neighborhoods.
