SOUTHEAST END OF THE BROADMOOR SHOPPING CENTER ORDINANCE NO. 5361 -71 AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA -1962 SECTION 40 AS AMENDED AND GENERAL ORDIN- ANCE NO. 4990 -68, AND THE ACCOMPANYING MAP THERETO, GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF THE USE DISTRICT FOR A CERTAIN PARCEL OF LAND, AS AMENDED. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section l: The municipal Code of the City of South Bend, Indiana 1962, and General Ordinance No. 4990 -68 and the accompany- ing map thereto, as amended, are further amended insofar as the same relates to that certain parcel of land situate in the City of South Bend, and known and disignated as: Lots Numbered Two Hundred Forty -seven (247), Two Hundred Forty -eight (248), Two Hundred Forty -nine (249), Two Hundred Fifty (250), Two Hundred Fifty - one (251), Two Hundred Fifty -two (252), Two Hundred Fifty -three (253) and Two Hundred Fifty -four (254) as shown on the revised plat of Broadmoor Third (3rd) Section an addition to the City of South Bend, County of St. Joseph, State of Indiana, by changing the classification of the "Use District" from "A" Residential use and "A" height and area district to "A" "C" Commercial use and 'W height and area district, and in conformance with the approved site plan on file in the office of the Area Plan Commission. Section 2: This ordinance shall be in full force and effect from and after its passage by the Common Council, approved by the Mayor and legal publication. JEFFERSON BLVD., SOUTH BEND, INDIANA 98801 (2DO 254 -9521 October 19, 1971 In re: Rezoning petition of Broadmoor Shopping Center, Inc. - Southeast end of Broadmoor Shopping Center_ located on Miami Street and Ireland Road in the City of South Bend. The above rezoning petition originated by Broadmoor Shopping Center, Inc. was legally advertised on September 11 and 18, 1971 and was given public hearing on Tuesday, September 21, 1971. The following action was taken at that hearing: After due consideration, it was moved, seconded and unanimously carried that the ordinance and site plan be recommended favorably to the Common Council of the City of South Bend subject to the site plan changes recommended by the Area Plan Commission staff and that it be restricted to "A" Height and Area, maintaining a 25 ft. sethack. A corrected site plan was approved by the Area Plan Com- mission's staff on October 18, 1971 and copies with the Commission's seal affixed thereto are attached.
