AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY
OF SOUTH BEND, INDIANA, DESCRIBED AS LYING GENERALLY
WEST OF HICKORY ROAD, SOUTH OF THE TOLL ROAD, EAST
OF IVY ROAD AND NORTH OF THE PRESENT CITY LIMITS.,
AS AMENDED. (MAPLE LANE)
Be it enacted by the Common Council of the City of South
BencJ, Indiana that:
Section 1 - The following described land, lying adjacent to
and forming a contiguous boundary with the present City Limits of the
Municipal City of South Bend, Indiana, more particularly described as:
Beginning at the northeast corner of the SE4 of Section 32,
T38N, R3E (which point is on the present City Limits line and
the centerline of Hepler Street); thence north along the east
line of said Section 32 to the northeast corner of said
Section 32; thence east or west along the north line of said
Section 32 to the southeast corner of Section 29, T38N, R3E;
thence north along the east line of said Section 29 to the south
right -of -way line of the Indiana Toll Road; thence westerly
along the south right -of -way line of the Indiana Toll Road a
distance of 5290 feet more or less to the west line of Section 29,
T38N, R3E, thence further west along the south right -o£ -way line
of the Indiana Toll Road a distance of 230 feet more or less;
thence south along a line 230 feet west of and parallel to the
west line of Section 29, T38N, R3E to a point 230 feet north of
the south line of Section 30, T38N, R3E; thence west along a
line 230 feet north of and parallel to the south line of
Section 30, T38N, R3E to the north and south centerline of said
Section 30; thence south 230 feet along the north and south
centerline of said Section 30 to the south line of said Section 30
(this south line also being the centerline of Douglas Road);
thence east or west along the south line of said Section 30 to
the northwest corner of the NE4 of Section 31, T38N, R3E; thence
south along the centerline of said Section 31 a distance of 5280
feet more or less to the south line of said Section 31; thence
east or west along the south line of said Section 31 to the
north 1/4 corner of Section 6, T37N, R3E; thence due south
40 feet; thence east along a line 40 feet south of and parallel
to the north line of said Section 6 a distance of 200 feet
more or less to the existing City Limits; thence due north
40 feet along the present City Limits; thence east along the
present City Limits to a point 432.3 feet east of the south-
west corner of the SE4 of Section 31, T38N, R3E; thence north
parallel with the west line of the SE4 of said Section 31 a
distance of 653 feet more or less; thence due east 18.3 feet
more or less to a point on the present City Limits line; thence
along the present City Limits line in a general

northeasterly direction to the northeast corner of
the SE; of Section 32, T38N, R3E, which is the point
of beginning, containing 950 acres more or less in
Sections 29, 30, 31 and 32, T38N, R3E in Clay Township,
and Section 6, T37N, R3E in Portage Township, all in
St. Joseph County, Indiana,
be, and the same hereby is, annexed as a part of the Municipal
City of South Bend, Indiana.
Section 2 - This Ordinance is to be in full force and
effect from and after its enactment, the approval of the Mavor,
and its publication according to law.

Respectfully report that they have examined the matter and that in their opinion
RECOMMENDS TH& PASSAGE O THE ORDINANCE BY THE COMMON COUNCIL `w ,
ATTACHED HERETO AND MADE A PART THEREOF THIS RECOMMENDATION IS THE
STATISTICAL DATA SHEET,,4WD A MAP OF THE AREA IN QUESTION, TIME TABLE
FOR THE RENDERING OF CITY SERVICES, PREPARED BY THE CITY ENGINEER
AND A CERTIFICATION OF THE BOARD OF PUBLIC WORKS & SAFETY AS TO THE
ORDINANCE MEETING THE LEGAL REQUIREMENTS FOR ANNEXATION.
THE COMMITTEE FURTHER ADVISES THAT ON THURSDAY, SEPTEMBER 23, 1971,
PUBLIC HEARING WAS HELD BY THE ANNEXATION COMMITTEE AT THE MORRIS
CIVIC AUDITORIUM. THE ARGUMENTS WERE ABLY PRESENTED BY BOTH SIDES
AT THIS MEETING. THE ATTORNEY FOR THE OWNERS OF PROPERTY WITHIN
THE PROPOSED ANNEXED AREA REQUESTSA PUBLIC HEARING BE HELD BEFORE
THE COMMITTEE OF THE WHOLE COUNCIL AND ALSO REQUESTS A POSTPONEMENT
OF SUCH PUBLIC HEARING TO A LATER DATE.
IT IS OUR OPINION THAT THIS WOULD SERVE NO USEFUL �jTRPOSE. THEREFORE,
WE RECOMMEND THE ABOVE REQUEST BE DENIED. /
