GAMMON Approved and signed by me 9 r i s Ig ?3 Clerk ORDINANCE NO. 5--k/ 89- 73 AN ORDINANCE TO APPROPRIATE $251,500.00 FROM THE LOCAL ROAD AND STREET FUND, AND $187,500.00 FROM THE TOPICS PROGRAM FUND FOR PROJECT R & S 57 - MC KINLEY HIGHWAY, LOGAN STREET AND HICKORY ROAD INTERSECTION PROJECT. .. ............................... WHEREAS, there was enacted during the 1969 Session of the Indiana General Assembly an Act, Chapter 392 of the Acts of 1969, making available to cities, towns and counties for engineering, construction or reconstruction of roads, streets and bridges under local jurisdiction, certain additional funds to be derived from the 7th and 8th cents of Indiana motor fuel tax and fuel use tax and from increases in fees levied under the Motor Vehicle Act; and WHEREAS, no appropriation of such funds was included in the regular 1973 budget for the Civil City of South Bend, Indiana; and WHEREAS, an emergency exists requiring the appropriation and expenditure of certain of said funds already received or to be received before the end of the year 1973; and WHEREAS, funds have been appropriated for the City's matching funds. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I. The following sums of money are hereby appropriated and ordered set apart out of the Local Road and Street Fund, and the TOPICS Program Fund for right -of -way acquisition, miscellaneous engineering costs and construction of the following project. The Federal Government through the TOPICS Program Fund is funding 50% of the Construction Cost. Richardson dl SUBJECT: R &S 57 - McKinley ghway, Logan Street and Hickory Road Intersection Project On March 12th you will hold a public hearing on subject project asking for'an appropriation of $251,500.00 from the Local Road and Street Fund and $187,500.00 from the TOPICS program fund. This project is a com- panion project to the one that Mishawaka is completing. We were ori- ginally scheduled to start the construction in this area last summer but due to right -of -way problems that cropped up on Hickory Road, we were unable to meet the schedule. The plans were originally done under the previous administration and has carried very high priority in the overall transportation system for the City. We have now negotiated the right -of -way and have submitted the final plans to the State Highway Commission in the hope that we can get an April letting and construction to start in May or June and have it finished yet this year. TOPICS funds 500% of construction costs. From LRSA funds we would ask for the other 50% of the construction funds which is $187,500.00, plus the additional costs for the right -of -way and the final engineering 'costs to complete the plans. The project will begin at Manchester Drive in an eastward direction and ultimately ending up at Hickory -Logan intersection with a 5 -1ane pave- ment and with curbs, gutters and new drainage along McKinley. On Hickory Road, the project will begin where the pavement narrows down at the south - side of the Ayr -Way's property south to McKinley Highway. The work on the east side of Hickory will be borne by the City of Mishawaka. On Logan Street, the work will begin approximately at the south property line of Bethel College and continue north into McKinley Road again, with new curbs, gutters and drainage. Most of the storm water on this project will be dumped into the new Hickory -Logan storm sewer that empties into the 36th Street lagoon south of Bercliff Estates. The storm water on the east end of the project will be dumped into the large ravine in that area near Manchester Drive and is being coordinated with the McKinley Terrace storm sewer project which is now under design.
